What is a "springing" power of attorney in BC?

A standard enduring power of attorney can be used as soon as it's signed, and it keeps working if you lose capacity. A "springing" one only starts when a trigger you name actually happens, usually loss of capacity.

It can sound safer, but it can also cause delays: banks and others may want clear proof that the trigger has happened before they'll deal with your attorney.

How much does probate cost in BC?

The government fees are set by law: nothing on the first $25,000, $6 per $1,000 up to $50,000, then $14 per $1,000 above that, plus a $200 court filing fee. On an $850,000 estate, that comes to $11,550.

Probate or "grant of administration" — what's the difference in BC?

If someone passes away with a will that names an executor, that person usually applies for a grant of probate. If there's no will, or no executor able to act, someone else applies for a grant of administration.

Either way, the court grant is often what banks and the land title office ask to see before they'll release or transfer sole-owned assets.
