This year's National AccessAbility Week theme is "Building a Strong, Accessible Canada."

It invites all of us, including governments, businesses, organizations, and individuals, to take action to advance a barrier-free country. Significant progress has been made to eliminate and prevent barriers, and by continuing to work together, we can build a truly accessible, inclusive and equitable Canada.

Our country is stronger when persons with disabilities can participate fully in all aspects of society.

POA-W Days are an opportunity for you to complete your Will and Powers of Attorney for only $100 (plus HST).

WHAT YOU NEED TO BRING:
-Your completed original will (can be purchased online, or in store, or created by a Certified Executor Advisor),
-Your completed Powers of Attorney (can be downloaded online for free- check our website)
-2 witnesses are required, You will need to bring 1 witness with you and 1 witness will be provided by TBH legal.

DO YOU QUALIFY To Have Your Loved One’s Capacity Assessment Fee WAIVED?
(🆕 info straight from the Capacity Assessment Office)

If you cannot afford the capacity assessment fee, you may be able to receive financial assistance. To apply to have your capacity assessment fee “waived” due to low income, you must fill out an application and then submit the application to the Capacity Assessment Coordinator at the Capacity Assessment Office.

The application is based on your annual family household income, ie: the requester, and/or the requester and his/her spouse. The application is NOT based on the income of the incapable adult.

NEW! - For your reference, the current income thresholds are:
🔵$33,000 for a single individual
🔵$45,000 for two people in a household

NOTE: Simply meeting the “income threshold” alone does not guarantee eligibility.
The full financial picture must be reviewed to determine whether someone qualifies for assistance.

INSTRUCTIONS ON HOW TO APPLY FOR FINANCIAL ASSISTANCE:

1️⃣ You can request the application form (Application to request Financial Assistance for a Capacity Assessment) from the Capacity Assessment Office by email: [email protected] or you can email [email protected] and we can send you a copy.

2️⃣ When you have completed the application,
the form can be submitted to the CAO the following ways:

🔵Mail: c/o Capacity Assessment Office, Ministry of Attorney General: 595 Bay Street, 8th Floor, Toronto, ON M5G 2M6

3️⃣ The applicant will receive a formal letter of approval or denial

Parents often ask...
"My son/daughter has had many "assessments" from medical professionals over the years… can we just use the Psychological Assessment report from their school? or the Assessment report from the DSO?"

-Unfortunately no, for THIS specific “Application Process*” to obtain Adult Guardianship of Property through the Office of the Public Guardian and Trustee (PGT), the ONLY acceptable form of “evidence” submitted to show that your loved one is not capable of managing their “property” is a Capacity Assessment based on Property that is completed by an Ontario Designated Capacity Assessor. The PGT will look for the “Certificate of Incapacity” specifically to manage Property, which is submitted together with the Capacity Assessor’s report.

NOTE: *Obtaining Guardianship through a "judge in court" is another way to obtain Guardianship of Property in Ontario, but is not discussed in this email.

If the applicant chooses to use TBH admin to help with the Guardianship of Property application process, we make picking a capacity assessor EASY- helping every step of the way!

For the Guardianship of Property application process through the Office of the Public Guardian and Trustee (PGT*), which is a service offered by TBH admin, we educate our clients to understand that a Capacity Assessment is an INTEGRAL part of the application process.

If the applicant qualifies and they choose to apply for Guardianship of Property using the application process, (take the pre-qualifying quiz here: https://tbhadmin.ca/ ), a Capacity Assessment for Property by a qualified, and trained, Government of Ontario approved Designated Capacity Assessor is REQUIRED.

Let's Talk About it... COURT VS APPLICATION PROCESS.

1) Through a judge in a court room👨‍⚖️
➡️ For the "Adult Guardianship" court process, it is very likely you will require a lawyer to advocate for you. Lawyers do not typically "educate" their clients. It is only their job to ensure they have done what you hired them to do.

VS.

2) Through an application process sent to the Office of the Public Guardian and Trustee (PGT)✉️
➡️ TBH admin provides a seamless, step by step approach to applying for Guardianship of Property through the Office of the Public Guardian and Trustee. TBH admin provides the applicant with "education" before, during and after the application process to ensure the applicant is well aware of what a "Guardian" is, and what is expected of them once they are approved as a Guardian of Property for their loved one.

Why ADULT GUARDIANSHIP?
because WE are a TEAM.


In Ontario🇨🇦, when an adult (18+) requires "help", or needs someone else to make decisions for them that they are not mentally capable of making, or act on their behalf by applying for benefits, or register for benefit programs etc.- the caregiver/helper is required to have legal authority to do so. This usually means having at minimum "Adult Guardianship of Property", and there are NO other options, alternatives, or substitutions for Guardianship of Property.

According to "Ministry of the Attorney General The Office of the Public Guardian and Trustee, Duties and Powers of a Guardian of Property", Queen's Printer for Ontario, 2007, Reprinted in 2020, Legal Responsibilities of a Guardian, Page 5...Your Legal Responsibility as a Guardian of Property means:
🔵 It is your responsibility to try to inform the incapable person of all their powers and duties, to the extent that the person is able to understand.
🔵 As the Guardian of Property, you must encourage the incapable person to participate, to the best of their abilities, in your decisions about the property.
🔵 You must consult from time to time, with supportive family members and friends who are in regular contact with the incapable person and with people providing personal care to the incapable person.
🔵 You must foster personal contact between supportive family members, caregivers, and the incapable person.

These points from the Office of the Public Guardian and Trustee booklet, all strongly emphasize that Guardianship of Property is a TEAM effort.
