If you are hurt and never find the car, you still have options. If you qualify for Accident Benefits your own insurance also provides up to $200,000 in damages under the Unidentified Driver coverage.

I hate to mention snow and ice before winter arrives but there have been recent changes in the Occupier's Liability Act that you should be aware of before the snow flies. If you are injured on private property due to someone's failure to remove snow and ice you only have 60 days to notify the owner and/or snow removal contractor. Not something you want to have to deal with on top of recovering from your injuries.

Access to accident benefits and tort compensation is tricky where an ATV is involved. The question of accessibility is informed by the complex potpourri of Insurance Act, the Highway Traffic Act, the SABS, and the Compulsory Automobile Insurance Act.
