The Federal Court has certified a class action seeking damages for Veterans Affairs Canada’s alleged underpayment of disability benefits to class members due to a supposed miscalculation in pension adjustment rates under s. 75 of the Pension Act.

Veterans Affairs Canada released a statement in 2018 addressing this issue and has been making corrective payments since September 2019, said a news release from class counsel Daniel Wallace, a lawyer at McInnis Cooper LLP. The class action submits that class members are entitled to additional payments, including those caused by other alleged errors in calculation.

The class is estimated to number around 270,000 members. It is composed of current and former members of the Canadian Armed Forces (CAF) and the Royal Canadian Mounted Police, as well as their spouses, common-law partners, dependants, survivors, orphans or estates. The class members are those who, sometime between 2002 and the present, have received certain benefits administered by Veterans Affairs Canada, including disability pensions and disability awards.

A man hires a paralegal to handle his divorce, only to discover his money and the paralegal were gone — and he's still married. It's a symptom of a bigger problem because, in many parts of the country, there's no way to tell if a paralegal has any training, expertise or insurance.

New Law on Child Support in Canada

The Supreme Court of Canada (SCC) has opened the door for payors of child support (usually the Dad) to get back money if they have overpaid the amount.

There is a catch--the Dad must be up front on giving his income information to the payee (Mom) and he must notify her that he has had a change in income so is earning less. If he has done so, he can bring an Application to the Court to ask for up to three years of credit for child support from the date of the notice.

The SCC is waiting for a case to be brought for where there is retroactive INCREASE in income to settle that law.

Review of “military culture” by Justice known for prosecuting war criminals is the wrong approach

EDMONTON: The Federal Government has announced that there will be a second review of “military culture” led by Justice Louise Arbour. It is the position of the Valour Legal Action Centre that this is a misguided and inappropriate distraction from the reality of military service. The choice of a Justice known for prosecuting war criminals sends a message that our military are all already guilty of something. This is far from the truth.

Branding the entire military as bad and wrong is not the approach to this issue. The Federal Government has effectively shut down all avenues of open communication and reception with the “all guilty” approach.

The reasons the first review was not received well by the members and veterans of the Canadian Armed Forces include:

1. Only hearing the voices of victims and not even attempting to listen to the majority of the people who wear the uniform;
2. Excluding the men who had experienced s*xual harassment and assault by female members;
3. Shutting out the voices of same s*x s*xual misconduct; and
4. The majority of military members and veterans are being unfairly painted with a broad brush which is undeserved.

This tainted review led to a report that was biased and prejudicial to any kind of fairness or openness to change. CAF and DND have failed to learn from any past reviews, reports and appeals during the investigative process. They will fail again using the same process to fit a narrative already written.

The Valour Legal Action Centre looks forward to being the voice of the majority—the men and women who serve Canada with honour and dignity. They deserve a voice at the table.

Vance thinks himself "untouchable" and Sajjan is just as corrupt. He needs to be held accountable to the Court of Public Opinion as well as the Rule of Law.

But even more... he needs to be held accountable to the men and women who serve with Honour in CAF that he blamed for his own corrupt behaviour.
