🛑 Part I vs. Part II: Don’t mix these up on exam day.

If you are prepping for the licensing exam, you need to know the procedural differences in the Provincial Offences Act cold. It is a classic exam topic that trips people up.

We broke it down in the slides above, but here is the summary:

👉 Part I (General Offences): Strict rules. You must be served personally. But be careful—if you ignore it, there is NO warning letter. After 15 days, you are deemed not to dispute and convicted. 🔨

👉 Part II (Parking): Flexible rules. The ticket goes on the car. Because you might not see it, the law gives you a safety net: a "Notice of Impending Conviction" is mailed to you before you are found guilty. ⚠️

🚨 P1 Exam Prep Alert! 🚨 Don't just memorize the rules—know how to apply them.
Swipe through for a high-yield breakdown of the Paralegal Rules of Conduct. Here is your study cheat sheet:

🏛️ Slide 2: Scope of Practice
Just because you *can* draft a Will doesn't mean you *should*. If a matter is outside the "permissible scope of activities" , you must decline the retainer.

🤐 Slide 3: Confidentiality
It lasts forever—even after the client dies. The only big exceptions? Imminent risk of death/harm or defending yourself against allegations of negligence.

⚖️ Slide 4: Conflicts of Interest
Watch out for "substantial risk" to your loyalty. Acting for two clients? You must warn them that no secrets are allowed between them.

🗣️ Slide 5: Advocacy
Be "resolute and honourable". You can represent a guilty client, but you can never knowingly put them on the stand to lie (perjury) or deceive the tribunal.

🚪 Slide 6: Withdrawal
Client stop paying? You can withdraw *unless* it causes "serious prejudice"—like if the criminal trial is tomorrow.

💰 Slide 7: Referral Fees
Memorize the math: 15% of the first $50k, 5% after that. The absolute hard cap is $25,000, no matter how huge the settlement is.

✅ Slide 8: Quick Hits
Undertakings: If you promise it, you *must* do it.
Unrepresented Persons: Explicitly tell them you do not protect their interests.

📌 Save this post for your final review session! Good luck, future licensees! 🎓

I passed the Ontario Paralegal Licensing Exam on my first try—not because I reinvented the wheel. I passed because I used proven, science-backed study methods. One of the most effective is called the testing effect.

If you’re done rereading and ready to test yourself, click here arevalolegal.etsy.com or check my bio to grab your bundle and start practicing today.

Find your weak spots before test day! Comment ‘testing’ if you’re studying smarter.

I didn't memorize everything. Here is my strategy. 🇨🇦
Studying for the Ontario Paralegal Licensing Exam can feel overwhelming if you try to memorize the entire Charter.
I focused specifically on the sections relevant to the P1 scope—the ones I needed to know by heart.

👇 I walk through the specific list of sections I memorized in the video linked below!

As Ontario Paralegals, our scope is distinct. We don’t deal with every corner of federal jurisdiction, but in our “trenches”—Traffic Court, Summary Criminal, and Tribunals—the Charter is a daily tool.
It’s not just about memorizing the rights; it’s about understanding where they intersect with our specific practice areas.
Which sections do you find most interesting (or most difficult) to deal with? Let’s discuss in the comments! 👇

Your brain is not a hard drive. 🧠
If you can’t find a topic in your index in under 10 seconds, you are losing marks. Trust your index, not your memory.
