Let’s think this through for a second 👇

If a client satisfies a condition, and you have the option to file a Notice of Fulfillment (NOF)…
Why would you have them sign a waiver instead?

An NOF says:
✔️ The condition was met. It was reviewed. It’s done and satisfied.

A waiver says:
❌ I don’t need the protection of this clause.
—or worse—
❌ This clause effectively never mattered.

Now imagine you’re in court and the condition itself is the issue.

An NOF proves the condition existed and was checked.
A waiver suggests the condition didn’t matter at all.

That distinction matters.

Example:
A furnace inspection report says the furnace is 5 years old (but it’s actually 25 due to a typo).

• NOF → The condition was fulfilled based on the information reviewed.
• Waiver → The inspection clause never mattered in the first place.

One protects the process.
The other erases it.

Words matter. Forms matter.
And the difference can be everything when things go sideways.
