How can debt affect the division of property after separation?

When calculating Net Family Property in Ontario, the answer is not always as simple as adding up assets and subtracting debts.

Contingent liabilities, including potential future obligations that may not yet be payable, can also become part of the discussion. Whether they should be recognized, and to what extent, can depend on the evidence, the likelihood of the liability arising, and the circumstances of the case.

In her latest article, Emma Robinson looks at how debt and contingent liabilities can affect equalization calculations and why these issues can become important when property is divided following a separation.

Married vs. Common Law: Property Rights Aren’t the Same in Ontario

When a relationship ends, how property is divided can look very different depending on whether you are married or living common law.

For married spouses, Ontario’s Family Law Act generally provides a framework for the equalization of property accumulated during the marriage. Common-law spouses, however, do **not** automatically have the same entitlement and may need to establish a claim based on their contributions to the relationship or property.

In our latest article, Emma Robinson breaks down:

🔹 How equalization works for married spouses
🔹 The importance of Net Family Property
🔹 How the matrimonial home is treated
🔹 Property rights for common-law spouses
🔹 Unjust enrichment and joint family venture claims

Understanding the difference can be important whether you’re entering a relationship, planning your future, or navigating a separation.

A review like this means a great deal to our team. ⭐⭐⭐⭐⭐

“Definitely the A-Team!”

After a long and challenging family law matter, this client shared their experience working with Ray Goddard, Tina Ricci-Zulli, Breanna McIntyre and Spenser Chalmers at Walker Head Lawyers.

What stood out most in their review was the strength of having an entire team working together — thoughtful strategy, steady guidance, detailed communication and clarity throughout the process.

In their words:

“In the end the value brought to the case exceeded the dollars spent.”

They recognized Ray for his strategic approach, Tina for her level-headed persistence and focus, Breanna for her meticulous attention to detail and communication, and Spenser for helping ensure documentation, costs and billing remained clear and complete.

We’re incredibly grateful when a client takes the time to recognize not just the outcome of their experience, but the people behind the work.

Thank you for placing your trust in Walker Head Lawyers.

Did you know?

A one-time RRSP withdrawal used to pay legal fees may be excluded from income for child support purposes in Ontario, but it depends on the reason for the withdrawal and the full picture of your finances.

Courts look at frequency, regularity, and especially why the funds were taken out when deciding whether inclusion would be fair.

For a clear breakdown of the key cases and what this means in practice, read our full article by Associate Emma Robinson:

Thinking of withdrawing from your RRSP to cover legal fees, support payments, or living costs during a separation?

In Ontario family law, those withdrawals are presumptively treated as income for child support purposes — but courts have discretion to exclude them when inclusion would be unfair.

Our latest article breaks down the key cases, the factors judges consider (especially the reason for the withdrawal), and why proper advice is essential.
