AGP partner Michael Spratt was quoted in this article examining a recent Supreme Court of Canada decision.

The takeaway is simple: the Crown usually doesn’t need to prove the exact timing of an offence… except when it does.

Where timing matters to an alibi or the fairness of the trial, it can be everything. Where it doesn’t, it isn’t.

Clarity on principles like this is critical. The SCC communicated that clearly to the public. If the system expects confidence, it has to explain itself.
