Termination vs. Layoff — they’re not the same thing.

A layoff is not always temporary, and in some situations, a layoff may be treated as a termination under Ontario law. What applies depends on the specific facts and the terms of the employment relationship.

Employee or Independent Contractor — the label isn’t everything.

Many businesses mistakenly classify workers as independent contractors when, in reality, they may be employees. This kind of misclassification can lead to significant penalties, tax issues, and legal consequences for both the business and the worker.

Determining whether someone is an employee or an independent contractor isn’t always clear-cut. A worker may have characteristics of both, and what matters most is the true nature of the working relationship — not just the title used. Simply calling someone an independent contractor does not automatically make them one.
