Why do you need a lawyer for a Real Estate purchase or sale?

In a real estate transaction, the lawyers act to ensure everyone gets what they agreed to, usually on the date they said they would. Land ownership is recorded at the Land Titles Offices, and transfers take 3-10 days to clear, depending on how busy they are.

Lawyers operate under a set of rules that ensure that when you hand over the land transfer to your house, you will get paid, and that if you are buying, that you will eventually get the piece of paper confirming you own the parcel of land you just took out a mortgage worth several hundreds of thousands of dollars to purchase.

What is Probate?

Probate is when a will is submitted to the courts, along with information about the deceased individual, their beneficiaries and their estate. A justice (which is what a Queen’s Bench judge is called) reviews the will and confirms it meets the requirements to be an actual will. At the end of this process a Grant of Probate is issued by the justice. This certificate allows the executor to begin collecting the assets of the estate.

Probate does not confirm that this is the last will of the deceased or prevent someone from bringing a claim against the estate. If someone contests a will, the probate process stops and a law suit begins.

Probate is a type of ‘desk application.’. This means your lawyer does not have to appear in front of a judge. They just send in paperwork for the judge to review privately.

What is the best day to close on a house?

Of the closings our firm deals with, between 70-80% happen on the 1st of the month, the 15th of the month or the last day of the month or on Fridays. These are popular dates because the line up nicely with leases that are coming to an end, and when you take possession of your new home on a Friday you have all weekend to move and set up your new home.

Keep in mind however that choosing one of these popular closing dates may result in delays due to high volume of other home buyers choosing the same dates. Closing on a Friday is also tricky if any issues arise as you will need to wait until the following Monday for the office to reopen. Talk to your lawyer and/or realtor to see what is best for you!

How did Olds get its name?

The year 1890 marks the beginning of the settlement which became the town of Olds. On 27 July 1891, the first through train made the trip from Calgary to south Edmonton. That same month the CPR took over the operation of the C & E Railway. A committee of CPR officials, charged with selecting names for the points along the line and the town site was named for a CPR traffic manager, George Olds.

He was born in Gloucestershire, England in 1832. He came to Canada as a young man and worked for a number of railways in Canada and the United States, returning to Canada in 1886 to join Canadian Pacific as a General Traffic Manager. He held this position until his retirement 10 years later. George Olds is buried in the cemetery at Airdrie, Alberta.

It appears that even before he retired from employment with the CPR in 1896, he lived for a time in the settlement that was named for him, running a store.
