In this one, ICBC denied our hardworking client's claim because they said he would not have returned to work following a devastating workplace accident. They ignored the evidence showing the exact opposite and forced him to trial.

The Court awarded him the earnings ($1.9 million) that he has now lost because a hit and run driver left him for dead in a ditch in Mission.

Without the right to fight ICBC, and go before an impartial judge, this client would have spent the rest of his life in poverty despite buying car insurance that he thought protected him in this exact situation.

We're happy to have helped this young woman achieve some justice in a province where the right to fight insurance companies has been almost completely eroded by David Eby and the NDP. ICBC claims her serious injuries were "minor". The Civil Resolution Tribunal disagreed and handed the matter off to Supreme Court of British Columbia on the main claim relating to Thoracic Outlet Syndrome:

What happens when you're on a jury in a case involving an ICBC defendant?

Maybe you'll have your private information illegally accessed by an ICBC adjuster so that it can be given to the defense lawyer.
This and other poor conduct on the part of David Eby's monopoly auto insurer was recently described in the Court of Appeal decision Insurance Corporation of British Columbia v. Ari, 2023 BCCA 331 (CanLII), https://canlii.ca/t/jzn2n

And in another jury case, ICBC's lawyers are sued by their former defendant client after a jury dropped a $4 million judgment on them. David Eby's Enhanced ICBC Dumpster Fire

David Eby's "enhanced" ICBC hit the front page of the Vancouver Sun after its most recent disaster in BC Supreme Court. Here's what the court said about the insurer that just charged this road star over $2700 for car insurance:

"Based on the consistent conduct of ICBC toward Ms. Taylor since her accident, I am unable to presume that ICBC will conduct itself honourably moving forward."

"It waits until a lawyer or the court is involved before it fulfills its obligations."

While they are paying you less after you've been hurt, they're paying their lawyers more to fight you if you try to access your benefits.

ICBC's army of private defence lawyers remain amongst the the highest paid public servants in the province.

According to one senior ICBC defence lawyer, ICBC just ramped up hourly fees paid to its lawyers to $400. Last year the 3 partners at his firm took in an average of $2.7 million dollars or nearly $1 million per lawyer at the firm ($8.2 million paid by ICBC to the firm).

ICBC's Enhanced Secrecy Program

6 years to trial to overturn ICBC's faulty claim that our client was 100% liable for a catastrophic car crash.

Here's 7 things that every person should know about s*xual abuse law here in Canada:

1. there is no time limit to sue an abuser. This is different than most other types of cases where there is a 2 year limit.

2. if we win in court, the bad guy can't escape paying for his abuse by declaring bankruptcy. He can lose his house. His car. And whatever else we can seize.

3. it does not matter if the police investigated before us and nothing came of it.

4. if you were married to an abuser, you can sue him. Often family lawyers fail to pursue abuse allegations and particularly when they are receiving legal aid.

5. coercive s*xual assault or battery is where one spouse uses threats of violence (sometimes against their own kids) to goad their partner into s*x. The law treats that the same as other s*xual abuse.

6. in cases of child s*xual abuse, many institutions have a duty to report abuse that they suspect or know about and can also be made defendants if they fail to report.

7. we are paid from whatever is recovered from the bad guy or bad institutions.

We received the British Columbia Supreme Court's judgment today in Piche, 2021 BCSC 1310.

In this latest trial, ICBC will pay around $1 million after double costs and disbursements. To put this in perspective: ICBC could have settled for $750,000 before trial. Their final offer of $400,000 was half the court award and nowhere near reasonable.

Under the new NDP/ICBC no-fault system, my amazing refugee client would have received almost nothing because he fought through serious injuries and went back to work in pain. He tried to start a business but needed people now to help him do the heavy tile setting work that he could do by himself before he was hurt. He needed a trial because ICBC didn't want to pay for that obviously crash related expense.

Saturday morning zoom trial and witness preparation with Justin Kiedrzyn. The young woman in this case was standing on the side of the road in Surrey, waiting to cross, when the ICBC defendant raced through a late yellow or red light, clipped a car turning left, and ran her down. She spent months in the hospital.

Under the new NDP/ICBC "enhanced care" system, she would receive almost nothing for a lifetime of pain and disability. And no lawyer to help her navigate a system that the NDP and ICBC has stacked against her. Women and children will be impacted the most.

In the last post I talked about the fact that there is no limitation period to bring a civil s*xual battery case against a bad guy. In this post, some information on what is relevant in a trial involving a s*xual assault or battery charge:

"To be clear, it does not matter that the complainant appeared to be interested in Mr. Nyznik. It does not matter that she was flirting, or kissing Mr. Kara, or that she willingly agreed to accompany a group of her male workplace colleagues to a strip bar. It does not matter if she was exchanging s*xual banter with the other two men in the back seat of the cab. It would not even matter if she proposed going back to the hotel to have group s*x (although I hasten to add that I am not finding as a fact that she made such a proposition). In terms of consent, all that matters is what happened at the time of the activity in question. Did the complainant consent? Or was she too incapacitated to consent? Whatever the complainant said or did earlier that night does not mean she consented later."
