We had the opportunity to attend “Canada’s Next Build Cycle” at the Terminal City Club, a high-impact executive session focused on the $330B federal capital investment wave reshaping infrastructure, housing, defence, productivity, and major projects across the country.

5 Things You Should Know Before Suing Someone in Canada 🇨🇦

1️⃣ Litigation is extremely expensive. Legal fees, court costs, expert reports and time away from your business can add up quickly.

2️⃣ It’s emotionally taxing. Court proceedings require preparation, disclosure of documents, and cross-examinations. It’s not just paperwork, it’s a process.

3️⃣ It takes time. In many Canadian courts, civil trials can take 2–3 years (or more) to reach a hearing date, depending on the province and court backlog.

4️⃣ Settlement should always be taken seriously. Canadian courts encourage dispute resolution, and refusing reasonable settlement offers can have cost consequences.

Her name is the only one on title… do I have rights?

In British Columbia, property rights are not determined by title alone.

Under the Family Law Act, spouses, including common law partners who have lived in a marriage-like relationship for 2 years or more, may have a claim to property acquired during the relationship, even if only one name appears on title.

If the Family Law Act does not apply, courts may still consider equitable remedies such as:

• Unjust enrichment
• Constructive trust
• Resulting trust

The court will examine:

• The nature and length of the relationship
• Financial contributions (down payment, mortgage, renovations)
• Indirect contributions
• The parties’ intentions
• Whether one party was unfairly enriched

Every case is fact-specific. Assumptions can be costly.
