5 more family law myths debunked –

1. The Courts will punish the party who leaves the marriage or commits adultery.

This is false. In Canada, we have no fault divorce. This means that no one will be punished for leaving the marriage. It may have no impact on marital property, custody or support obligations.

2. If my child inherits my estate, their spouse is entitled to half

This is false. An inheritance is one of the exceptions of the Marital Property Act which is not considered marital property. It will only become marital property once it is used for the family.

3. Paying child support entitles access to the payor –

Child support is an obligation to the parent that does not have primary care. They must pay regardless if the Court grants them access to the child or not.

4. I have to go to Court to get a separation or divorce –

In Canada, 98 % of cases settle before they ever see the court room. It is less expensive and easier when parties are able to settle outside of court.

5. If the parties were not married and they separate no party has to pay spousal support.

In New Brunswick, there may be an obligation for common law couples to pay spousal support. This is based on the parties’ incomes, the length of the relationship and entitlement issues.

5 Common Family Law Myths Debunked:

1.To end a relationship you need to get a “legal separation” –

To separate you just have to leave the person. However, when separating there are lots of factors that need to be considered like:

Where will the children stay?
How will property be divided?
Does one party have to pay child support?
Does one party have to pay spousal support?
Who will stay in the house?

2. If you live apart for 7 years you will be legally divorced if you are married –

You must be granted a divorce in New Brunswick to be legally divorced. In order to get a divorce you must file a petition for divorce.

3. Common-law couples who live together for 3 years have the same rights to property as people who are married -

Regardless of how long you have lived together no party has an automatic right to property upon separation.

4. If you do not want to see your child, you do not have to pay child support -

In New Brunswick, if you make over $12,000 annually and are not the primary caregiver of the child you have an obligation to pay child support.

5. If you deliberately stay unemployed or underemployed, or get paid cash you do not have to pay child support -

The Courts in New Brunswick are able to impute income on parties who try to hide money and not work to avoid paying child support. Essentially, they will decide how much the payor should make a year and the payor would have to pay child support based on that amount.
