Successful resolution secured in a Federal Court immigration matter after litigation proceedings were commenced. The matter will now be re-determined by a different officer, with the Applicants being given an opportunity to provide updated documentation.

A positive step forward in a visitor visa matter

Our client, a 30 years old applicant from India, applied to visit Canada to spend time with her sister. Following a refusal, we challenged the decision and the matter will now be re-determined by a different officer.

We are pleased to share a successful outcome in Sadeghimotlagh v. Canada (Citizenship and Immigration), 2024 FC 1569 (CanLIl).
In this case, a study permit refusal was challenged where the officer questioned the applicant’s intent to return and dismissed the study plan. The Federal Court found that the decision lacked meaningful engagement with the evidence, including the applicant’s family ties and academic purpose.
