Mike MacLellan Kelsey Orth had the pleasure of speaking to members of the Barrie Construction Association about how to build a valid COVID-19 vaccine policy in the construction industry. We had the benefit of a flurry of legal activity over the past week and a half. They reviewed four recent decisions regarding COVID-19 workplace policies. All four came to slightly different conclusions, and in our estimate, all four are correctly decided based on their specific contexts. In fact, that is a key finding in each of these labour arbitration decisions: that a policy will stand or fall based on the specific circumstances of the specific workplace.

Template or precedent policies can be very useful as a starting point, but there is just no substitute for a properly-drafted and personalized COVID-19 workplace policy that takes into account things like: what restrictions or obligations need to be in place; what alternatives exist; can employees be easily accommodated or have their duties modified.

In the latest instalment of the blog from CCPartners, Mike MacLellan reviews a recent wrongful dismissal decision from Ontario. This one has a bit of a unique twist. The parties agreed that the only issue was the common law notice period. The employee argued that she ought to be owed a larger damages award due to the fact that she was five months pregnant at the time of her termination. The Court agreed. Its reasoning, and lessons for employers, are included in this week's article.
