FRANCOPHONE IMMIGRATION OUTSIDE QUEBEC

Canada has created various initiatives to attract and retain French-speaking immigrants outside Quebec, including:

• Express Entry for French-speaking skilled workers
• Francophone Mobility Work Permit
• Francophone Minority Communities Student Pilot (FMCSP)

Express Entry for French-Speaking Skilled Workers
To be eligible for the Express Entry for French-speaking skilled workers, you must meet the following requirements:

Express Entry Profile
• You must have an active profile in the Express Entry pool.
• You must be eligible for one of the federal economic immigration programs managed through Express Entry:
o Federal Skilled Worker Program (FSWP)
o Federal Skilled Trades Program (FSTP)
o Canadian Experience Class (CEC)

Language Proficiency
You must achieve a minimum score of 7 in all 4 language abilities (speaking, reading, writing, and listening) on the Niveaux de Compétence Linguistique Canadiens (NCLC).

Francophone Mobility Work Permit
The Francophone Mobility Work Permit is a special type of work permit that makes it easier for French-speaking foreign nationals to work in Canada outside Quebec:

LMIA-exempt Work Permit
The Francophone Mobility Work Permit exempts employers from the requirement to get a Labour Market Impact Assessment (LMIA) to hire foreign workers (exemption code C16).

Eligibility
To be eligible to apply for the Francophone Mobility Work Permit, you must:
• Have a valid job offer for a skilled occupation under any Training, Education, Experience and Responsibilities (TEER) category of the National Occupational Classification (NOC) system unless the offer of employment is for a job in a primary agriculture occupation under TEER 4 and 5.
• Demonstrate that your French speaking and listening skills are equivalent to a level 5 or higher in the Niveaux de Compétence Linguistique Canadiens (NCLC) Scale).

Francophone Minority Communities Student Pilot (FMCSP)
The Francophone Minority Communities Student Pilot (FMCSP) is a special program to encourage international students to study in French in communities outside Quebec.

Benefits for Students
• A provincial attestation letter (PAL) or a territorial attestation letter (TAL) is not required when applying for a study permit through this pilot.
• The FMCSP provides a pathway for students and their families to apply for permanent residence after graduation.
• Students can access settlement services to help them integrate into their new communities.
• Students’ spouse/common law partner and dependent children may be eligible for a temporary resident visa, study permit or open work permit.

Program Criteria
• The program must be at the post-secondary level.
• The program must be full-time.
• The program must be at least two years long.
• The program must lead to a degree or diploma.
• French must be the primary language of instruction (over 50% of classes taught in French).

• You must demonstrate you have enough money to pay the tuition fees and support yourself and your spouse or common-law partner and dependent children, if they come with you to Canada, during your studies.

Note, the amount of money you need to prove depends on the city where the main campus of your school is located.

• You must live outside of Canada when you apply.

HOW TO APPLY FOR PROVINCIAL NOMINATION UNDER PNP

A Provincial Nomination is granted by provinces/ territories to permanent residence applicants under a Provincial Nominee Program (PNP). It certifies that the skills, education and work experience of an applicant are in demand in a specific province/territory. It also confirms that the applicant meets economic or labour market needs of the province/territory and of Canada.

There are 2 ways by which you may apply for a Provincial Nomination:

(1) through the non-Express Entry process
To apply through the non-Express Entry Process, you need to apply directly to the province/territory. If you meet the eligibility requirements of the province/territory, you will be nominated and will need to apply for permanent residence by using the regular online application process.

(2) through Express Entry if the province/territory has an Express Entry stream
You may apply for a provincial nomination through Express Entry by either:
 applying for a nomination under an Express Entry stream of a province/territory; OR
 creating an Express Entry profile, selecting the provinces/territories you are interested in, and applying to their Express Entry stream for provincial nomination if you receive a “notification of interest.”

The benefits of applying for a Provincial Nomination via Express Entry (as opposed to the non-Express Entry process) are:
• faster processing time of permanent residence applications
• receiving 600 additional CRS points in the Express Entry profile, which will practically guarantee receiving an invitation to apply (ITA) for permanent residence.

Express Entry is an online management system that manages applications for Canadian permanent residence for three immigration programs: Federal Skilled Worker Program, Federal Skilled Trades Program, or Canadian Experience Class.

Since the launch of Express Entry in 2015, top-ranking candidates in the Express Entry pool were invited to apply for permanent residence through "general rounds of invitations” and “program-specific rounds of invitations.”

On May 31, 2023, Canada announced launch of “category-based rounds of invitations," in addition to "general rounds of invitations” and “program-specific rounds of invitations.” In category-based rounds of invitations, candidates with the highest Comprehensive Ranking System (CRS) score in a specific category are invited to apply for permanent residence.

Please note, candidates must first meet the minimum requirements for Express Entry, including qualifying for one of the Express Entry programs: Federal Skilled Worker Program, Federal Skilled Trades Program, or Canadian Experience Class.

Categories are set by the government to meet a specific economic goal and are announced in advance. For 2023, the government has chosen the following categories:

1. French language proficiency
2. Work experience in the following fields:
• healthcare
• science, technology, engineering, and mathematics (STEM) occupations
• trade occupations
• transport occupations
• agriculture and agri-food occupations.

CANADA INCREASED RESETTLEMENT SPACES FOR HUMAN RIGHTS DEFENDERS

On July 25, 2023, Canada increased the number of resettlement spaces for Human Rights Defenders and their family members from 250 to 500.

To seek refugee protection in Canada, Human Rights Defenders facing persecution in their home country should contact the UN High Commissioner for Refugees (UNHCR). The UNHCR will then refer the Human Rights Defenders to Immigration, Refugees and Citizenship Canada (IRCC) for assessment under its Urgent Protection Program (UPP). Under the UPP, a decision to resettle a refugee is made within 24-48 hours.

On July 15, 2023, Canada announced a Permanent Residence pathway for Ukrainian nationals.

To apply for Permanent Residence, Ukrainian nationals must be in Canada with a temporary resident status, and be a spouse, common-law partner, parents, grandparents, siblings and children or grandchildren of a Canadian citizen or permanent resident.

The pathway will launch on October 23, 2023, and further details will be available closer to that time.

Since the CUAET closes at 23:59 (ET) on July 15, 2023, as of July 16th, Ukrainians will need to pay government fees and to comply with standard requirements to come to Canada as a visitor.
