I. 2026年7月1日生效的修訂

**空調-新增RTA第36.1條

如果房東不提供空調,租客可以在出租單元內安裝和使用窗式或便攜式空調,除非房東根據第36.1(2)款禁止安裝,並且符合第36.1(3)款規定的條件。

**技術性修訂-第36.1條72 RTA

第 72 條刪除「自 2017 年《租賃公平法》第 13 條生效之日起」的表述。

**經委員會批准的書面協議格式 — RTA 第 206 條

解決申請事項的書面協議必須採用委員會批准的格式。

**提高個人最高罰款額 — RTA 第 238 條

任何人違反本法,一經定罪,可處以不超過 $100,000 的罰款(原為 $50,000 )。

**關於空調的法規制定權 — RTA 第 241 條

委員會可訂定規章,規範窗型或可攜式空調的安裝、使用和維護,包括規定相關情況和附加條件。

II. 2026年9月21日生效的修正案

**房東在房屋翻新後通知租客的義務- RTA第53條

如果房東已發出終止租賃通知(N13),要求進行需要騰空房屋的維修或翻新,且租客已行使優先續租權 (Right of refusal to re-occupy),以原租金重新入住該租賃單元,則房東應在租賃單元準備好入住後立即以書面形式通知租客。

**前租客申請的時效期限-RTA第57.1條

如果房東未能履行優先續租權,前租客可以提出申請。

申請必須在以下兩者中較晚的日期之前提出:

- 前租客搬離租賃單位之日起兩週年;或

- 維修或翻新工程竣工之日起六個月。

Bill 97, the Helping Homebuyers, Protecting Tenants Act, 2023, received Royal Assent on June 8, 2023. Schedule 7 of this bill includes amendments to the Residential Tenancies Act, 2006 (RTA). Order in Council 617/2026 prescribes the coming‑into‑force dates for specified RTA amendments as follows:

I. Amendments in Force on July 1, 2026

**Air Conditioning — New s. 36.1 RTA

A tenant may install and use a window or portable air conditioner in a rental unit where the landlord does not supply air conditioning, unless the landlord prohibits the installation under subsection 36.1(2), and subject to the conditions set out in subsection 36.1(3).

**Technical Amendment — s. 72 RTA

The phrase “on or after the day section 13 of the Rental Fairness Act, 2017 comes into force” is struck out from section 72.

**Board‑Approved Form for Written Agreements — s. 206 RTA

A written agreement resolving the subject‑matter of an application must be in the form approved by the Board.

**Increased Maximum Fine for Individuals — s. 238 RTA

A person, other than a corporation, who is guilty of an offence under the Act is liable on conviction to a fine of not more than $100,000 (increased from $50,000).

**Regulation‑Making Authority re: Air Conditioners — s. 241 RTA

The Board may make regulations governing the installation, use, and maintenance of window or portable air conditioners, including prescribing circumstances and additional conditions for these purposes.

II. Amendments in Force on September 21, 2026

**Landlord’s Obligation to Notify Tenant After Renovation — s. 53 RTA

Where a landlord has given a Notice of Termination (N13) for repairs or renovations requiring vacancy, and the tenant has exercised a right of first refusal to re‑occupy the rental unit at the same rent, the landlord shall notify the tenant in writing, without delay, once the rental unit is ready for occupancy.

**Limitation Period for Former Tenant’s Application — s. 57.1 RTA
A former tenant may apply if the landlord fails to honor the right of first refusal.

The application must be made by the latter of:
-The second anniversary of the day the former tenant vacated the rental unit; or
-Six months after the day the repairs or renovations are completed.

根據 Order in Council 616/2026 樞密院令 616/2026 的規定,經修訂的《2006 年住宅租賃法》(Residential Tenancies Act, 2026 -RTA)相關條款將於 2026 年 7 月 1 日生效,具體如下:

(A) 2026 年 7 月 1 日

- 所有終止租約通知書應使用經 LTB 核准的標準格式(RTA 第 43.1 條);

- 申請覆核(Request to review)的期限由 30 天縮短至 15 天(RTA 第 209(2) 條);

- 賦予委員會新的權力,包括規定 (i) 通知格式、(ii) 資格和要求、(iii) 條件或限制,包括複核程序及相關程序事項的條件或限制(RTA 第 241.1(1) 條)。

根據Order in Council 618/2026 樞密院令 618/2026 的規定,2006 年《住宅租賃法》(Residential Tenancies Act, 2006 - RTA)的特定修訂條款將於 2026 年 9 月 21 日生效,具體如下:

(B) 2026 年 9 月 21 日

- 若房東就 N12 條款(房東自用)向房客發出至少 120 天的通知,則可免除一個月的租金補償(RTA 第 48.1 條);

- N4 條款(未支付租金)的終止日期從向租戶送達通知後的 14 天縮短至 7 天(RTA 第 59(1) 條);

- 授權委員會管理和處理過渡期和/或附表 12 修訂實施過程中產生的相關問題(RTA 第 241.5 條)。

The specified amended sections of the Residential Tenancies Act , 2006 (RTA), will come into force on July 1, 2026, as set out in the Order in Council 616/2026 as follows:

(A) JULY 1, 2026

- The standard form(s) approved by LTB should be used for all notice(s) of termination given (s.43.1 of RTA);

- A Request to review an order is shortened to 15 days from 30 days (s.209(2) of RTA);

- Assigning the Board's new power in terms of prescribing (i) forms of notices, (ii) qualifications and requirements, (iii) conditions or limitations, including those governing the conduct of a review and related procedural matters (s. 241.1(1) of RTA).

The specified amended sections of the Residential Tenancies Act , 2006 (RTA), will come into force on September 21, 2026, as set out in the Order in Council 618/2026 as follows:

(B) SEPTERMBER 21, 2026

- One-month rent compensation can be waived if the landlord provides the tenant(s) with at least 120 days' notice for an N12 - Landlord's Personal Use (s.48.1 of RTA);

- The termination date of N4 (non-payment of rent) is shortened to 7 days from 14 days, when the notice is served on tenant(s) (s.59(1) of RTA);

- Assigning the Board's power to govern and manage the related issues arising from the transition period and/or the implementation of the Schedule 12 amendments (s. 241.5 of RTA).
