As of October 26, Realtors who operated their business through a personal bank account are eligible for the Canada Emergency Business Account (CEBA). CEBA is a Federal government program that provides interest-free loans (up to $40,000) to help small businesses during COVID-19. Repaying the balance of the loan on or before December 31, 2022, will result in loan forgiveness of 25 per cent (up to $10,000). As COVID cases are increasing again, we’re cognizant of the safety of our clients’ and staff members’ safety. Accordingly, we are moving back to remote signing when possible to better assist our clients. However, as many offices begin to employ remote commissioning, it’s important to be mindful that some banks as well as private mortgage sources do not accept remotely signed legal real estate documents. Therefore, it’s important for commissioners and agents to check with the lender ahead of time. There are also 5 requirements for remote commissioning:
1. Must be able to see, hear, and communicate with signer in real time throughout the entire transaction.
2. Confirm the identity of the deponent.
3. Use a modified jurat indicating that commission was administered in accordance with the regulation (O. Reg. 431/20) for taking commissions and including location of both commissioner and the deponent.
4. Take reasonable precautions, including ensuring that the deponent understands what is being signed.
5. Keep a record of the transaction.

Ontario's Main Street Recovery Plan was announced last week, which will propose legislation to support small businesses by removing certain hurdles. The plan will include a one-time grant of $1,000 for eligible main street small businesses (e.g., retail, food, and accommodation sectors) with 2–9 employees to offset the costs of PPE. The plan will also include personalized business advice, digital support to grow online businesses, mental health support, etc. More info is available at news.ontario.ca

The Business Names Act, R.S.O. 1990 states that no corporation, individual, or persons in a partnership shall carry on business or identify itself to the public under an unregistered corporate or firm name. There are limited exceptions to this rule.
