If you are a victim of s*xual assault living in and would like to speak to a lawyer, you are likely eligible for up to four hours of free and confidential legal advice.

The application and eligibility criteria are relatively simple.

A few things to keep in mind:

🔹️This service does not include legal representation in court.

🔹️This service is confidential and is available any time after a s*xual assault has occurred.

Is reporting gender-based and s*xual violence ( ) to Western University an option in your case? It depends on the situation. Here are some of the key requirements:

1️⃣ You (the complainant) must be a member of the university community.

2️⃣ The respondent must have been a member of the university community at the time that the act of gender-based violence occurred.

3️⃣The respondent must be a member of the university community at the time the complaint is filed.

4️⃣The incident(s) giving rise to the complaint must not have been previously investigated and decided under the Student Code of Conduct or Non-Discrimination and Harassment Policy.

🌟 Also know that a formal REPORT or COMPLAINT of GBSV is different than a DISCLOSURE of GBSV.

Disclosure: The sharing of information by a survivor with a member of the university community concerning and incident of GBSV.

Report / Complaint: The sharing of information concerning an incident of GBSV with the intention of initiating a formal, non-criminal process with the university. The process for reporting an incident of s*xual violence to the university is outlined in Western’s Policy on Sexual Violence.

Deciding whether to report s*xual violence is the right of the survivor. Know that accessing support and resources does not require the filing of a formal complaint with the university.

🚨 Did you know that in Canada, there are NO limitation periods for reporting s*xual assault criminally?

Choosing if and when to report s*xual assault or pursue any other legal action is a deeply personal decision. In some cases, the law recognizes this fact and provides some flexibility to survivors. However, strict deadlines continue to exist in other forums.

Here are some examples:

🔸️ CRIMINAL: In Canada, survivors can report a s*xual assault to the police at any time after the assault.

🔸️ CIVIL: In general, there is no limitation period to start a civil lawsuit for damages (compensation for injuries and losses) sustained as a result of s*xual assault.*

⚠️ HUMAN RIGHTS TRIBUNAL OF ONTARIO (HRTO): the Human Rights Code requires s*xual harassment claimants to bring their claims to the HRTO within ONE YEAR of being harassed. (Sexual harassment includes s*xual assault in this context).

* There are many exceptions. For example, if the perpetrator passes away, you may only have 2 years from their death to start a lawsuit.

If you have questions about the legal options available to survivors of s*xual violence, book an appointment with a LISA volunteer. Here are some things you can discuss:

➊ POLICE REPORTING AND THE CRIMINAL LEGAL PROCESS
Learn more about how to report to police, what the criminal legal process looks like and what to expect as a complainant. You will never be pressured to report.

➋ CIVIL LEGAL OPTIONS
Survivors of s*xual violence may have options outside the criminal system. Learn about civil lawsuits, the process, and types of compensation that may be available.

➌ THE HUMAN RIGHTS TRIBUNAL
The Ontario Human Rights Code says every person has the right to be free from discrimination based on s*x. This includes s*xual harassment. Learn how you can file a complaint at the Human Rights Tribunal of Ontario.

➍ WESTERN’S COMPLAINT PROCESS
Learn more about Western’s disclosure and/or formal complaint process, which is available if both the victim and perpetrator are members of the university community.

➎ REFERRALS (LEGAL & NON-LEGAL)
Ask us for referrals to lawyers, legal services, and other community resources that may be able to support a survivor of s*xual violence.

LISA provides a judgment-free and confidential space where ay Western student on main campus can meet with a trained law student to discuss legal options and resources available to survivors of s*xual assault or abuse.

You will NEVER be pressured to report, disclose or pursue any legal remedy discussed.

✉️ To make an appointment, please email [email protected] with your preferred times to meet and format of the appointment (in-person or virtual). Please DO NOT provide information about the assault or the perpetrator in your email.
