COVID Divorce Advice

"Familiarity breeds contempt" is an old expression which is trending nowadays because of the need for couples to self quarantine due to Covid 19.

The answer for many troubled couples appears to be the easy way out, namely pulling the plug on the marriage and arranging a consultation with a family lawyer, like myself.

While there are certainly instances of domestic violence or abuse which should trigger an immediate and appropriate legal response I urge anyone considering their legal options to first consider whatever couples counselling services and support may be available before talking with someone like me. And please also consider counselling for any children, often the forgotten ones.

This current covid pandemic is not an excuse for parents to deny, or frustrate parenting orders or agreements with their former partners, ostensibly on the basis of protecting the welfare of the children.

Yet, this seems especially to be the case these days.

In a recent discussion I had with a BC Provincial Judge on this same topic, she made it very clear, the current policy of BC family courts is to ensure that orders and agreements are to be respected and obeyed despite the pandemic.

Bonfire of his Vanity

"Burning through cash" is a common expression with a purely symbolic meaning.

Not so if you happen to be Bruce McConville.

Bruce recently told a judge in Ontario when questioned about his failure to pay his ex child and spousal support, that he had literally set fire to one million dollars in cash.

Not surprisingly there were no other witnesses to the bonfire.

Unimpressed with this novel, and far fetched excuse, Bruce was sent to jail for 30 days and fined $2000 a day until he provides financial disclosure.

Children under the age of majority, (19 here in BC) aren't legally allowed to vote, purchase liquor, or to***co or va**ng products.

I believe most adults would consider that a common sense restriction since children clearly lack the age and maturity to make good choices.

Well you may, or may not, be surprised to hear that at least in one recent case here in BC a child was able to decide to pursue hormone therapy despite the objections of one, but not both, of the parents.

But in my opinion it would not have mattered if both parents had objected to the treatment. Children are allowed to make medical decisions, both major and minor, without the knowledge and/or consent of their parents.

Whether such treatment is in a child's best interests is apparently best left to the child, and/or the courts.

Next up, drinking, voting and smoking.

The phrase child support, to most people, means paying the parent responsible for caring for any children. However, there is another alternative meaning, often overlooked.

In this case child support means ensuring that the children of separating and divorcing parents receive the emotional and psychological support they both need and deserve.

I can't recall how often when I meet clients who are in the throes of separation, and ask about the emotional state of the children, I am told that the children are doing perfectly fine.

These are the same children who, for years, have typically witnessed and observed, or worse, the acrimony and bitterness exhibited between their parents.

This is simply a call out if you happen to be a parent with children experiencing separation or divorce to take the time to think about the impact on your children, even if they appear to be perfectly fine.

Just remember separation and divorce is not just about you and your ex, your children are every bit as involved and most importantly affected.

A Vancouver woman was recently ordered by a Judge of the Supreme Court of BC to pay $200 k to an ex-boyfriend she was found to have defamed using Instagram and other social media sites. Which just confirms what your parents always told you, "if you have nothing nice to say, say nothing at all".

And if you happen to be on the giving, or receiving end, of such activity you will need good legal advice, so keep me in mind!
