How is pain and suffering calculated after an injury in Atlantic Canada?

It is not a random number. Courts look at how your injury changed your daily life, your age, and your mental health.

Insurers calculate it differently. Know the difference.

Had a pre-existing condition before your injury in New Brunswick, Nova Scotia, or PEI? That does not disqualify your claim.

If a collision made it worse, you may still be entitled to compensation.

Insurers will use your medical history against you. Know your rights in Atlantic Canada.

Myth: A police report proves who was at fault after a car accident.

Fact: It documents the scene but does not determine legal liability.

Fault in a personal injury claim is decided separately. A report is one piece of evidence, not the final word.

A free case review costs you nothing.

Slipped on ice, in a parking lot, or at a store in Atlantic Canada?

Property owners owe you a duty of care.

You may have a slip and fall claim.

A free case review costs you nothing.

When an insurer sends you to a doctor, that doctor works for them. The exam is brief, the report is written for the insurer, and it focuses on what you can do, not how you feel after.

Your own doctor's records still matter. But insurers lean heavily on the IME. Know what you are walking into.

A free case review costs you nothing.

Get witness details and stay at the scene.

If anyone saw what happened, get their name and number before they leave. That information does not always end up in the police report.

If authorities are on their way, stay put and let them finish at the scene.
Save this series so you have it if you ever need it.

Not all injuries are treated the same under the law in Atlantic Canada.

New Brunswick, Nova Scotia, and PEI all cap what you can recover for pain and suffering if your injury is classified as "minor."

But if your injury crosses into "serious" territory, that cap does not apply. If you are not sure where your injury falls, a free case review can help.
