🧾 Contents Coverage: Why Personal Belongings Are Often Undervalued After a Loss

After a fire or flood, many homeowners focus on rebuilding but it's often their personal belongings that become the most disputed part of a claim.

📌 What is contents coverage?
It applies to your furniture, clothing, electronics, appliances, and other personal items damaged or destroyed by the loss.

📌 Common issues homeowners face
• Items are depreciated more than expected
• Detailed inventories are commonly required during the claims process, often within set timelines
• Replacement values don't reflect real‑world costs
• Sentimental or custom items are difficult to document

📌 Why these matters during a claim
Contents claims can represent a significant portion of the overall settlement. How items are listed, valued, and justified can make a meaningful difference in what's ultimately recovered.

Understanding how contents coverage works and how valuations are assessed can help homeowners avoid underpayment and unnecessary stress during an already difficult time.

If you're navigating a contents claim and feel your belongings are being undervalued or overlooked, Virani Law can help you understand your coverage and options.

🏠 Claim Delays & Understanding the Claims Process

Have you experienced a delay in your insurance claim and aren't sure what's normal?

After a residential loss, it's common for the claims process to involve multiple steps, reviews, and requests for information. While some parts of the process naturally take time, understanding how claims typically move forward can help reduce uncertainty during an already stressful period.

📌 What the claims process generally involves:
• Initial assessment and review of the loss.
• Ongoing communication about next steps.
• Requests for information or documentation as needed to evaluate coverage.

📌 Situations that may raise questions
•Extended periods without updates.
•Requests for information that seem repetitive.
•Lack of clarity around what is needed to move the claim forward.

📌 The takeaway Not all delays are unusual, but when a claim remains unresolved or unclear for an extended period, understanding the process and the legal rights under your policy can help you navigate next steps with more confidence.

If your claim has been delayed and you're feeling unsure about next steps, Virani Law can help you gain clarity and move forward with confidence.

⚖️ Things to Know About the Insurer's First Offer

The first settlement offer is based on the insurer's assessment of your loss and how your policy coverage is applied.
In some cases, it may be a fair and positive offer based on the information available. However, it's always in your best interest to have it reviewed to ensure nothing has been missed or misinterpreted.

📌 Things to compare
• Repair estimates vs. offer amount
• How your policy coverage was applied
• Any missing or overlooked damages

📌 Why this matters? Even when an offer looks reasonable, differences in valuation or interpretation can affect the final outcome. A careful review helps ensure the settlement reflects the full extent of your loss.

If you're unsure whether a settlement offer accurately reflects your coverage and damages, Virani Law can review it with you and help you understand your options moving forward.

⚖️ Understanding the Legal Side of a Property Insurance Claim

A property insurance claim is a legal process from the moment it's filed. The inspections, estimates, and documentation are all tied back to your policy which is a contract with legal considerations.

It's important to remember:
📌 An insurance policy is a binding contract Coverage decisions are based on specific wording, exclusions, conditions, and endorsements not just initial assessments.
📌 Policyholders have legal rights and Insurers have obligations under both the contract and applicable insurance law.
📌 Limitation periods and procedural requirements can affect how and when a dispute can be addressed.
📌 Documentation shapes the outcome How losses are presented, valued, and supported can significantly influence how a claim progresses.

Understanding the legal framework behind your policy can provide clarity and direction especially in complex residential losses.
Virani Law assists homeowners in navigating property insurance claims with careful analysis and steady guidance.

🏠 Have you experienced a residential loss and feel unsure navigating your insurance claim?

After a fire or flood, the claims process can feel unfamiliar and, at times, overwhelming. Many homeowners aren't sure when, or if, they should involve a lawyer.

Early guidance can help prevent common issues before they escalate into larger disputes.

Here are a few situations where it may be worth seeking clarity early:

📌 At the start of a significant property loss
📌 If you're unsure what your policy covers (or what it requires of you)
📌 If the claims process feels unclear or difficult to follow
📌 Before disagreements develop or positions become entrenched

⚖️ Why early involvement matters

Getting support early isn't about creating conflict. In many cases, it's the opposite.
It can help:
• Clarify your rights and obligations under the policy
• Ensure key steps are handled properly from the outset
• Identify potential gaps or issues early
• Reduce the risk of delays or prolonged disputes later on.

The takeaway: Insurance claims often become more complicated when issues are addressed later in the process. Early clarity can help keep the claim on track and avoid unnecessary setbacks.

If you're navigating a property loss and want to better understand your position, getting informed early can make the process more manageable.

🚫Top Reasons Fire Insurance Claims Get Denied, And How to Avoid Them

Filing a fire damage claim is stressful enough and a denial can make it feel even more overwhelming. But many denials come down to a few avoidable issues.

Here's what we want every homeowner to know:

📸 Lack of documentation: Always document your damage clearly and thoroughly.
📄 Policy exclusions: Not all fire-related damage is covered, especially if negligence or lack of maintenance is involved. Know what your policy doesn't include.
⏱️ Delayed reporting: Waiting too long to notify your insurer could invalidate your claim. Always report damage as soon as possible.
🗣️ Misrepresentation: Even unintentional errors can raise red flags. Be accurate, clear, and honest when reporting the facts.
💵 Unpaid premiums: If your policy isn't active at the time of loss, the claim won't move forward. Stay on top of payments to protect your coverage.
📉 Insufficient limits: If your coverage doesn't reflect your home's true value, you may only receive partial payment or worse, a denial.

💬 If your fire damage claim has been denied, or if you're worried it might be, reach out today to schedule a free consultation with our team.

🏠 Have you experienced a residential loss and feel unsure as you navigate your insurance policy?

In many cases, the answer to "what's covered" isn't just in the base policy, it's in the endorsements and riders attached to it.
These additions are designed to customize coverage, and they can significantly impact how your claim is handled.

Here are a few examples:
📌 Valuable items
Standard policies often have limits on high-value belongings like jewelry, art, or collectibles. A scheduled property endorsement may increase or clarify that coverage.
📌 Water-related damage
Damage from sewer backup or overland water is often excluded unless specific coverage has been added.
📌 Additional living expenses
Coverage for temporary housing after a fire or major loss may depend on both your base policy and any enhanced endorsements.
📌 Replacement vs. actual cash value
Some endorsements affect how your property is valued — which can directly influence how much is recoverable under a claim.
📌 Home-based businesses
If any part of your home is used for business purposes, coverage may depend on whether this was specifically added to the policy.

The takeaway: After a loss, endorsements and riders often determine the difference between partial and more complete coverage. These details are easy to overlook, but critical when a claim is underway.

If you're navigating a claim and aren't sure how your endorsements apply, understanding your policy in detail can help you make more informed decisions moving forward.

📢Attention Jasper residents: a legal deadline is approaching.📢

As you know the 2 year anniversary of the Jasper wildfire is
approaching and with it an important legal deadline as well.

Under Alberta law, homeowners typically have two years to take legal action related to an insurance claim. For many Jasper wildfire losses, this period may end around July 22–24, 2026.

That doesn't mean your claim needs to be settled by then. It means if your claim is unresolved and you haven't protected your legal rights, you could lose the ability to sue, even if negotiations are still ongoing.

A few things worth knowing before that deadline hits:

📌Some insurers, including Intact, have been willing to extend the limitation period. But an extension only protects you if it's confirmed in writing for your specific claim. Don't assume you're covered because someone else received one.

📌Before you can file a lawsuit, you're also required to file a Proof of Loss, a sworn detailed document that quantifies every part of your claim. Preparing it properly can take weeks to even months.

We've put together a full article covering what the deadline means, how extension agreements work, and what steps to take right now if your claim is still unresolved.
