Earlier this month, the Law Society announced an initiative that will increase access to family law help, by allowing articling students to attend to more family law matters than previously allowed. Here is what was posted:

"Effective January 17, 2022, the Law Society, in partnership with the Superior Court of Justice and the Ontario Court of Justice, is launching a pilot project which will allow eligible lawyer licensing candidates (including candidates completing their work placements as part of an integrated practice curriculum program at Lakehead or Ryerson) to attend to an increased number of matters related to family law cases without first needing permission of the court pursuant to rule 4(1)(c) of the Family Law Rules.

It's that time of year again to reflect on the past year and look ahead to the future. In 2020 law firms were suggesting there was a 40% increase in divorce inquiries since the beginning of the pandemic. Economic downturn often brings about an increase in divorces, and this year was no different. As expected, the Courts have been experiencing delays in processing divorces, due in part to the the closures of the last 2 years. We are hoping 2022 will alleviate some of the backlog. We hope to continue to serve our clients well and to help them reach resolution.

We wanted to take the opportunity to highlight some resources this Holiday season, that are not so joyful, but very much a part of reality. If you are ever in the situation where you are self-isolating with an abusive partner, here are some things to note according to StepsToJustice.ca:

- if anyone is in immediate danger, call the police 911;
- if you're in an abusive situation these are some community places that are open around the clock, or more than others: police stations, fire stations, or grocery stores;
- keep in touch with friends and family who can help you and provide emotional support;
- find or make a safe room (avoid kitchens);
- know every exit in the house;
- Carry your phone with you at all times, tucked away, etc.

Here is a list of 24/hr helplines (you can call anonymously):

- The Assaulted Women’s Helpline, at 1-800-863-0511
- Fem’aide, if you speak French, at 1-877-336-2433
- Talk4Healing, if you are an Indigenous woman living in Northern Ontario and speak English, Ojibway, Oji-Cree, or Cree, at 1-855-554-4325
- Ganohkwasra Family Assault Support Services, if you are part of the Six Nations of the Grand River community, at 519-445-4324; etc.

Let's talk about Marriage Certificates. This is not the same as a marriage license, it is a record of marriage. It lists the date and place of the marriage, and names of the people who were married. A record of solemnization of marriage is also not the same as a marriage certificate. When you get married, it usually takes between 6-8 weeks to be be able to order a certificate.

You will also be looking for a marriage certificate if you're looking for a divorce, as it is required for the Divorce Application. Ordering one is an easy online process with Service Ontario with a set fee of $15.00 or for expedited service, $45.00.

To order a marriage certificate you need:

- the marriage to be registered in Ontario;
- first and last names or single names of both parties to the marriage;
- dates of birth of both parties to the marriage;
- date of marriage, and
- name of city, reserve or town where the marriage took place in.

Service Ontario takes the following payments:
Online: Visa, Visa Debit, Mastercard, Debit Mastercard and Interac® Online
or
In-person at 47 Sheppard Avenue East, Toronto: cash, money order, Visa, Visa Debit, Mastercard, Debit Mastercard and Interac®

A divorce is a costly and emotionally taxing event. A simple divorce is also known as an uncontested divorce. This usually means you and your ex spouse agree to divorce. It is mostly a written court process, usually without the need to appear in front of a Judge. Often times lawyers charge a flat fee for proceeding with an uncontested divorce on a client’s behalf. ⁠

• Have you been separated for at least 1 year?⁠
• Have you (or your ex spouse) mainly lived in Ontario for at least one year?⁠

These are just a few of the factors involved in separation.

Are you thinking about getting married? Or perhaps about getting a divorce? Do you know the difference between changing your name legally or assuming a name? Read below to understand how those options affect you.

1. Assuming a name
You do not have to get a legal name change to use your spouse's name as your last name. Instead, you can assume your spouse's name. Assuming a name is not a legal name change, so it does not change your birth certificate. Most people assume a name instead of undergoing a legal name change - it is very common.

2. Legal Name Change
A legal name change involves legally changing a person's forename name (first and/or second name); and/or the individual's surname (family name).
If you elect to legally change your name and were born in Ontario, that this type of name change will result in changing your name on your birth certificate - it will look like you were born with this name. This requires an application to be submitted to Service Ontario and a fee of $137.00 (November 3, 2021). If you ever wish to revert back to your previous name at any time, you will need to contact the Office of the Registrar General.

There is a lot to consider before getting married or divorced. Have you ever considered a marriage agreement or perhaps ending one with a separation agreement?
