First, what is an LMIA?

LMIA stands for Labour Market Impact Assessment. It’s a document that many Canadian employers need to obtain before hiring a foreign worker.

Now imagine this:

Your work permit is about to expire, but your employer’s LMIA application is still being processed.

Does that mean you have to stop working or leave Canada?

Not necessarily.

Under a process known as Concurrent Processing, eligible workers may be able to submit their work permit application while the LMIA is still under review.

This can help you avoid gaps in status while waiting for a decision.

You may qualify if:
✔️ Your current work permit will expire within 14 days or less
✔️ Your employer submitted the LMIA application on time
✔️ You meet the other eligibility requirements

If your work permit expires while your new application is being processed, you may benefit from Maintained Status, allowing you to continue working legally for the same employer under the same conditions until a decision is made.

One important detail:

After submitting your work permit application, you'll typically have a limited period to provide proof that the LMIA was approved. If you fail to submit the approval within the required timeframe, your application could be refused.

So if the LMIA is approved, upload it as soon as possible.

Also keep in mind that some employers may currently be unable to obtain LMIAs for certain low-wage positions in specific regions affected by government restrictions. If your employer falls into one of these areas, it could impact your available options.
