Alberta now recognizes a new privacy tort: intrusion upon seclusion.

In BD v Germain, 2026 ABKB 590, the Alberta Court of King’s Bench recognized the tort of intrusion upon seclusion, providing a potential civil remedy where a person’s private affairs or concerns are intentionally or recklessly invaded without lawful authority.

The decision addresses circumstances where privacy may be invaded even when private information or recordings are never shared or published. The Court also adopted a test that considers the invasion from the perspective of a reasonable person in the plaintiff’s position.

Prowse Barrette LLP lawyers Melissa Boyles and Philip Prowse acted for the plaintiff in this matter. They also acted for the plaintiff in ES v Shillington, 2021 ABQB 739, where the Court recognized the tort of public disclosure of private facts in Alberta.

Welcome, Seanachie Clarke!

We’re pleased to welcome Seanachie to the team at Prowse Barrette LLP as an Associate.

Seanachie received her Juris Doctor from the University of Alberta Faculty of Law and joined the firm following the completion of her articling term. During her articles, she gained experience in civil litigation, wills and estates, and corporate commercial law.

With a background rooted in music, Seanachie has extensive classical training in viola and singing and has performed internationally across Europe, South Africa, and China. She also participated in competitive Highland dancing and amateur tenor drumming throughout her childhood.

Outside of the office, Seanachie enjoys reading, travelling, lifting weights, and spending time with friends and family.

Welcome, Almog Mazor!

We’re pleased to welcome Almog to the team at Prowse Barrette LLP as a Student-at-Law.

Almog brings a background in policy and community relations, where he worked on public affairs initiatives and engaged with government and community stakeholders. He earned a Bachelor of Science (Honours) in Biochemistry before completing his Juris Doctor at the University of Alberta Faculty of Law.

During law school, Almog founded the Jewish Law Students’ Association and mentored first-year law students, supporting them in developing their advocacy skills.

Outside of the office, Almog enjoys following hockey and basketball, reading history, and spending time in Edmonton’s River Valley.

Giving back to the community we’re proud to call home.

The Prowse Barrette LLP team recently spent time volunteering at the Bissell Centre, helping in the kitchen and supporting the important work they do in Edmonton’s downtown community.

We also had the opportunity to learn more about Bissell Harvest Catering, a catering program that helps raise funds to support food programs and other nonprofit initiatives throughout the city.

We’re grateful for the opportunity to contribute, learn more about the community we serve, and support an organization making a difference in Edmonton.

Commercial contracts can have significant implications for how risk and liability are allocated between parties.

In Strongco Corporation v Nordstrong Equipment Limited, 2026 ABCA 274, the Alberta Court of Appeal provided important guidance on the interpretation of indemnity clauses relating to a party’s own negligence.

The Court confirmed that the longstanding Canada Steamship principles are guidelines rather than a rigid legal test. Indemnity provisions should instead be interpreted using the modern approach to contractual interpretation, considering the agreement as a whole, its commercial context, and the intentions of the parties.

The Court also emphasized the importance of clear contractual language when allocating responsibility for a party’s own negligence and noted that interpretations promoting commercial certainty should generally be preferred.

Why do courts need to provide reasons for their decisions?

A recent Federal Court of Appeal decision highlights the importance of sufficient reasons in judicial decision-making. The Court found that the Federal Court’s reasons did not adequately explain how it reached certain conclusions, including concerns about the adoption of a party’s proposed order.

Clear and sufficient reasons help demonstrate that the relevant issues and evidence have been independently considered, while also allowing decisions to be meaningfully reviewed on appeal.

The decision serves as an important reminder of the role that procedural fairness and transparency play in the justice system.
