Is every whiplash injury subject to Alberta’s minor injury cap?

No. A whiplash injury is not automatically capped.

Alberta’s minor injury cap limits pain-and-suffering compensation for certain auto injuries, including many sprains, strains, and whiplash injuries. But if your injury has caused a serious, lasting impairment that substantially affects your ability to work, attend school, or manage daily life, the cap may not apply.

If an insurer has told you your claim is capped, or you are worried it may be, speak with an experienced injury lawyer before accepting that assessment. The real impact of your injury matters, and the insurance company’s first answer is not always the final word.

The Alberta Auto Insurance Rate Board’s latest data shows average claim costs across all coverages dropped from $1,825 in 2024 to $1,398 in 2025.

That is a major decrease.

Yet Albertans are still being told they must give up their right to fair compensation, independent medical assessments, and access to the courts under the proposed Care-First model.

The evidence does not support the claim that injured people or bodily injury claims are driving costs out of control. Severe weather was a major factor in 2024. And while claim costs have dropped, premiums continue to rise.

Albertans deserve transparency. They deserve an evidence-based discussion. And they should not lose important rights for savings that have not been proven.
