Approval 1: Vulnerable Open Work Permit

2️⃣ Work permit approved in 55 days

A vulnerable worker open work permit may be available to eligible foreign nationals in Canada who are experiencing or are at risk of experiencing abuse in the context of their employment and meet the applicable work permit requirements.

Approval 2: C51 Work Permit

1️⃣ Client was working as a PSW in long-term care

2️⃣ C51 work permit approved in 71 days

2 Important Eligibility Factors for a C51 Work Permit

1️⃣ You need a qualifying job offer where the proposed work can qualify as work of a charitable nature under the LMIA-exempt provisions.

2️⃣ The actual job and duties must be charitable in nature and connected to a recognized charitable purpose. Simply working for a non-profit or charitable organization does not automatically make every position eligible.

CRA recognizes four broad categories of charitable purposes:

1. Relief of poverty

2. Advancement of education

3. Advancement of religion

4. Certain other purposes that benefit the community in a way recognized as charitable

The C51 exemption is connected to work of a religious or charitable nature under IRPR section 205(d).

Important: 2 Main Eligibility Factors for the C51 Work Permit

1️⃣ You need a qualifying job offer from an organization where the employment can meet the requirements of the C51 charitable work LMIA exemption.

2️⃣ The job offer itself must be charitable in nature. It is not enough that an organization is simply a non-profit or registered charity. The actual employment and duties need to support qualifying charitable purposes.
