🚨 TWO C51 WORK PERMIT MYTHS — LET’S CLEAR THEM UP!

Many people believe that only registered charities can support a C51 charitable work permit and that every eligible job must be permanent and full-time. Those claims are too broad.

✅ Myth 1: Only registered charities qualify.
A nonprofit that is not registered as a charity may still be considered if its purpose and the actual work meet the charitable-work requirements.

✅ Myth 2: You must have a permanent, full-time job.
Permanent, full-time employment is not a universal requirement expressly stated in IRPR R205(d). Part-time or casual work may be possible, depending on the facts and supporting evidence.

⚠️ Important: working for a nonprofit does not automatically qualify you. IRCC assesses whether the work itself is charitable in nature, and the application must meet the applicable requirements.

🚨 C51 REFUSED — THEN APPROVED AFTER RECONSIDERATION! 🇨🇦

This case had a very unusual timeline.

📅 August 7: C51 application submitted while the applicant was in restoration.

📨 August 31: Two requests were sent to IRCC asking to cancel the first request.

⏳ September 8: Restoration period ended.

❌ September 11: C51 application refused.

⚖️ After refusal: Reconsideration request submitted.

✅ October 6: C51 APPROVED!

The important lesson is that a refusal does not necessarily mean the case is the end of the road. The appropriate next step depends on the circumstances and the reason for refusal.

For this case, a reconsideration request was submitted and ultimately resulted in approval.

🇨🇦 WHAT IS C51?

C51 is associated with IRPR 205(d), which permits work of a religious or charitable nature to qualify for an LMIA exemption.

However:

❌ Working for a nonprofit does not automatically qualify.

❌ Working for a registered charity does not automatically qualify.

✅ IRCC assesses whether the actual work is charitable in nature.

Charitable purposes can include:

1. Relief of poverty
2. Advancement of education
3. Advancement of religion
4. Other purposes beneficial to the community in a way recognized as charitable

⚠️ RESTORATION POINT

A restoration application does not provide work authorization while it is being processed. IRCC states that people who lose status must stop working and normally cannot resume until status is restored and a new work permit is issued.

🚨 SPOUSAL OPEN WORK PERMIT APPROVED — 62 DAYS! 🇨🇦

Another SOWP approval — this time the application was approved for 3 YEARS.

But there’s an important detail:

👉 The principal applicant had a qualifying job offer but had not started working yet.

Under IRCC’s current rules, the principal applicant can be “employed or will be employed” in a qualifying occupation at the time the spouse submits the application.

✅ BASIC ELIGIBILITY

The principal applicant generally needs:

1. Valid work authorization

A valid work permit, work permit approval, or applicable authorization to work without a permit.

2. Canadian employment

The principal applicant must live or plan to live in Canada while working.

3. Qualifying occupation

The job must be:

✅ TEER 0
✅ TEER 1
✅ OR a specifically listed TEER 2/3 occupation.

4. 16-month requirement

For the standard high-skilled worker category, the work authorization generally needs to be valid for at least 16 months after IRCC receives the spouse’s application.

⚠️ Important: Not every TEER 2 or TEER 3 occupation qualifies. IRCC has a specific NOC list.

Why is the CRS so high in a PNP draw?

An Express Entry-aligned provincial nomination provides 600 additional CRS points.

IRCC conducts program-specific rounds for candidates eligible for the Provincial Nominee Program.

So a candidate’s 725 CRS in a PNP draw should not be compared directly with the CRS cutoff from a CEC, French-language or other category-based draw. They are different round types with different eligible populations.

Sharing a recent Express Entry permanent residence approval for a couple from Nepal with foreign work experience.

📅 Complete Timeline

1️⃣ Application submitted: February 3, 2026

2️⃣ Biometrics: April 8, 2026

3️⃣ Portal 1: September 4, 2026

4️⃣ Portal 2: September 16, 2026

5️⃣ COPR: September 21, 2026 🎉

⏱️ Approximately 7½ months from application submission to COPR.

The application was approved without an ADR or PFL being issued in this particular case.

For an Express Entry application, IRCC assesses whether the applicant meets the requirements of the applicable program and whether they are admissible based on factors including medical, police certificate and background checks.

For applicants in Canada, IRCC can confirm permanent residence through the Permanent Residence Portal, after which an electronic COPR can be made available.

📌 Eligibility Requirement No 1

You must have a full-time or part-time job offer from a registered charity or eligible non-profit organization.

AND

The job itself must be charitable in nature, meaning the work must support one or more charitable purposes recognized by the Canada Revenue Agency (CRA):

🚨 Study permit holders in Canada — don’t assume your permit is valid just because the expiry date hasn’t arrived.

If you withdraw from your program and are no longer enrolled at the DLI named on your study permit, IRPR 222 can make your study permit invalid before the expiry date printed on the document.

A study permit becomes invalid on the first applicable date:

1️⃣ 90 days after completing studies
2️⃣ The day you are no longer enrolled at the named DLI, unless because you completed your studies
3️⃣ The date the permit expires

Always check your individual circumstances before stopping your studies.
