When you’re Fighting Like Cats and Dogs… Who Gets Custody of the Fur Babies?

The fact that your babies are fuzzy makes them no less near and dear to your heart than do the genetics of direct progeny of couples in the midst of separation. You would be forgiven for presuming that the Family Law Act recognizes, and responds to this. Alas, this is not the case, as notwithstanding our deep affection for our pets, the law recognizes our animals as property, not progeny. Essentially, therefore, principles pertinent to the division of family property apply. Effectively, proof of ownership is required to lay claim to ‘custody’.
Members of the Bench, in the writer’s experience, will often endeavor to encourage creative solutions to this issue. Where children are involved, and attached to family pets, parties are frequently encouraged to consider the impact upon them, and invited to adopt a de facto ‘shared custody’ arrangement so as to ensure minimal impact upon the best interests of the child post-separation. Where the dispute involves separating adults, without children involved, a variety of resolutions will be commended to parties’ consideration prior to judicial determination; however, in the final analysis, if parties cannot agree, ‘custody’ of pets, will be driven by determination of ownership.
