Legal Tip Tuesday: Before you buy, make sure you understand what comes with the property and what doesn't.

Two terms every buyer should know:

An easement is a legal right that allows someone else to use a portion of your property, or allows you to use a portion of someone else’s property, for a specific purpose. Think shared driveways or utility access. You still own the land, but that right belongs to someone else and remains with the property regardless of who owns it.

A restrictive covenant is a rule that limits how you can use or modify your property. This could affect additions, appearance, or how the space is used. These rules also transfer with ownership, meaning they apply to you even if they were set by a previous owner years ago.

Neither of these is necessarily a dealbreaker, but they can affect your plans in ways that aren't obvious at first glance. A renovation you're counting on, a business you planned to run from the property, or a structure you intended to build could all be impacted.
