A statutory declaration must be completed according to specific requirements and declared before someone authorized to receive it, including a BC Notary Public.

An affidavit is a written statement of facts that a person swears or affirms to be true before an authorized official, such as a notary public.

Affidavits may be required for court proceedings, government applications, estate matters, and other legal or administrative purposes. Because the person signing is formally confirming that the contents are true, it’s important to carefully review and understand the document before swearing or affirming it.

Thank you to everyone who joined us for our estate planning seminar. It was wonderful to see so many people from the Comox Valley and Campbell River taking the time to think about their families, their wishes, and the importance of having the right documents in place.

We had some great questions and conversations about Wills, Powers of Attorney, Representation Agreements, and some of the issues that can arise when an estate plan hasn’t been properly considered.

A special thank you to Grant Powers and Ryan Williams for sharing their knowledge and perspectives. Bringing together the legal, financial, and real estate sides of estate planning made for a really valuable discussion.

And most importantly, thank you to everyone who attended, participated, and trusted us with your questions.

If you weren't able to attend but have been meaning to review your estate plan—or if you don't have one in place yet—please don't put it off. These are conversations that are much easier to have while you're healthy and things are going well.

If a document needs to be witnessed or notarized, it is often important that it be signed in the presence of the notary.

The notary may need to verify identity, administer an oath or affirmation, witness the signature, or complete a specific form of certification. Signing beforehand can sometimes mean the document needs to be completed again. Following the instructions provided before your appointment can help avoid unnecessary delays.

A Will is an important part of planning, but it only deals with what happens after death. A broader personal plan may also include a Power of Attorney for financial and legal affairs and a Representation Agreement for personal and healthcare decisions during your lifetime.

Considering these documents together can help ensure trusted people are able to assist you both during your lifetime and after your death.

Being named executor is an important responsibility. Depending on the estate, the role can include locating the Will, identifying and protecting assets, notifying institutions, dealing with debts and taxes, applying for probate when required, and eventually distributing assets to beneficiaries.

Choosing an executor who is trustworthy, capable, and willing to manage these responsibilities is an important part of creating a Will.

Preparing some information before a Will appointment can make the planning process easier. Consider your assets and liabilities, the people or organizations you would like to benefit, who you trust to act as executor, and any wishes involving minor children or specific property.

You don’t need to have every decision finalized before meeting with your notary — the planning conversation can help clarify the choices that need to be made.
