Update on Real Estate Transactions

Our industry has just experienced a significant change that I want to bring to bring to public attention. Effective October 1, 2025, title insurance companies will be considered “reporting entities” under the Proceeds of Crime (Money Laundering) and Terrorist Financing Act (PCMLTFA). In plain terms, this means that when you buy or sell property, your title insurer will now have obligations to report certain details of your transaction to FINTRAC, Canada’s financial intelligence unit.

Here’s what this means for you, in practical terms:

• You may be asked to sign a new consent form. Your lawyer may need to act as the title insurer’s “agent” to help them gather the required information. That can only happen with your clear, written consent.

• Your personal information will be shared with FINTRAC. This includes your name, address, date of birth, property details, purchase price, mortgage details, and potentially the vendor’s information.

• Lawyers are not a FINTRAC reporting entity. Our obligations as your lawyer remain under the Law Society rules and lawyers must obtain your written consent before sharing your information. Any reporting obligations belong to the title insurer, not the lawyer.

• These changes are designed to combat fraud and money laundering. While it may feel like more paperwork, the intent is to create stronger safeguards against fraud and financial crime in real estate transactions.

This is a significant shift in how title insurers operate, but your lawyer’s role remains the same: to protect your interests and guide you through the process with clarity.
