Ignoring litigation does not make it go away — and in some cases, it can make the consequences significantly worse.

A recent Ontario decision, Flegg v. Sigma Lithium Corporation, 2026 ONSC 2596, serves as a strong reminder that courts can and will proceed when a party fails to participate. In this case, the defendant did not attend trial or make submissions, and the court awarded substantial damages, including aggravated and punitive damages, costs, and interest.

For businesses, employers, and individuals, the takeaway is clear: early legal advice matters. Responding strategically from the outset can help manage risk, protect your position, and avoid conduct that may increase financial exposure.

Artificial Intelligence is changing the way many people approach research, writing, and document preparation — including in the legal system.

However, courts across Canada are making it clear that AI-generated legal materials must be carefully verified before they are relied upon. Fabricated case law, inaccurate legal arguments, and unsupported authorities can lead to serious consequences, including fines, cost awards, findings of misconduct, and damage to credibility before the court.

The key issue is not whether AI was used. The issue is whether the materials submitted to the court are accurate, lawful, and properly supported.

AI may be a useful tool, but it does not replace legal training, professional judgment, or the duty to ensure that court filings are correct. For both lawyers and self-represented litigants, responsibility for accuracy remains with the person signing and filing the documents.
