🚨 Important LMIA Update for Canadian Employers! 🇨🇦

Effective August 18, 2026, there is an important update affecting employers with fewer than 10 employees at a specific work location who are hiring temporary foreign workers in low-wage positions.

For the purpose of calculating the low-wage cap, the workforce size will be treated as 10 employees.

👉 10% cap: Maximum 1 low-wage temporary foreign worker
👉 20% cap: Maximum 2 low-wage temporary foreign workers

The workforce calculation can also include full-time and part-time employees, certain employees on leave, vacant positions requested through the LMIA, and temporary foreign workers approved under previous LMIAs who have not yet started working.

⚠️ Employers: make sure your cap is calculated correctly before submitting an LMIA application.

Follow Ardent Law Group for more updates on LMIA applications, work permits, Canadian immigration, and employer compliance.

Applying for Humanitarian & Compassionate (H&C) permanent residence in Canada? 🇨🇦

Saying you’re established in Canada isn’t enough — your evidence needs to show the life you’ve actually built here.

Employment records, pay stubs, T4s, Notices of Assessment, housing documents, community involvement, volunteer work, support letters, and your children’s establishment may all help demonstrate your ties to Canada.

Every H&C application is assessed based on its individual circumstances, so strong, organized supporting evidence matters.

Already married outside Canada and thinking about getting married again in Alberta? 💍⚖️

Being separated for several years does not automatically end your first marriage. If that marriage is still legally valid, you are still legally married and generally cannot marry someone else.

If you meet Alberta’s residency requirements, you may be able to obtain a divorce in Alberta even if your original marriage took place in another country. Once the divorce is finalized and legally effective, you can move forward with obtaining an Alberta marriage licence and marrying your new partner.

Separation is not divorce. Know your legal status before saying “I do” again.

Every situation is different. Speak with a qualified family lawyer about your specific circumstances.

⚖️ When does a tragic accident become legal negligence in Alberta?

Not every injury, accident, or unfortunate event means someone was legally negligent. Alberta courts look at the evidence and specific legal requirements—not assumptions or public opinion.

A negligence claim generally involves four key elements: duty of care, breach of the standard of care, causation, and damages. If one element cannot be established, the claim may not succeed.

Understanding the difference between an accident and legal negligence can make a major difference when assessing your rights.

⚠️ New IRB AI Rules Are Coming — Refugee Claimants Need to Know This! 🇨🇦

Thinking about using AI to write or rewrite your refugee story? Starting September 7, 2026, new IRB rules will restrict the use of artificial intelligence in personal evidence submitted in refugee proceedings.

Your Basis of Claim (BOC) narrative, affidavits, witness statements, and other personal evidence must reflect your own experiences, memories, and words. AI should not be used to generate or materially change your personal evidence or to create or alter supporting evidence such as photographs or screenshots.

Minor assistance such as spellcheck, grammar correction, and formatting may still be permitted where it does not generate or materially change the evidence.

Your refugee story is your story. Make sure the evidence you submit accurately reflects what you personally experienced.

Separation and divorce are NOT the same thing in Canada. ⚖️🇨🇦

You can be separated for years and still be legally married. Separation changes your relationship and living arrangements, while divorce legally ends the marriage through a court order.

Understanding the difference can affect your rights involving property division, parenting, child support, spousal support, and remarriage.

Thinking about separating or getting divorced? Know your legal rights before making major decisions.

🇨🇦 Can your company transfer you to Canada without an LMIA?

If you work for a multinational company, you may be eligible for an LMIA-exempt Intra-Company Transfer (ICT) work permit. 💼✈️

Eligibility can depend on your previous employment with the foreign company, the relationship between the foreign and Canadian businesses, your proposed position in Canada, and whether you meet the applicable ICT requirements.

Executive, senior managerial, and certain specialized knowledge positions may qualify—but not every company or employee is eligible.

Before applying, make sure the corporate structure and supporting documents meet the immigration requirements.
