以往响境外申請Study、Work Permit, 但係用旅客身份先入境加拿大嘅申請人, 當收到IRCC移民部發出嘅 “Letter of Introduction” (即係Approval Letter), 最常用、以及最快拎到Permit嘅方法就係去邊境行一個圈, 俗稱 “Flagpole”, 簡單嚟講就係出境再入境。 其實張Approval Letter有講, 响正常情況下申請人由外地飛抵加拿大, 過海關嘅時候, 關員就會發出簽證俾申請人。之不過, 先前因疫情關係, 加拿大同美國邊境封咗關, 無得Flagpole, 近日疫情情況放緩, 邊境已經重開, 但係Flagpole似乎出現咗一啲變化。
首先係關員嘅態度, 有啲客人嘅反應就話關員嘅問題尖銳咗, 亦有啲Case直頭唔俾張Permit你, 叫你用Visitor身份入境。而且近排啲Approval Letter亦唔同咗樣, 特別係加咗以下內容:
“Your application to work / study in Canada has been initially approved by Immigration, Refugees and Citizenship Canada. The final decision to issue you a work / study permit and allow you to enter Canada is made after an examination by an officer in Canada. At that time, an officer will assess if you still meet the requirements of the Immigration and Refugee Protection Act, its Regulations and any other Canadian legislation.”
即係話就算IRCC移民部批咗, 不過最終決定權係响海關關員度。最近小蕃薯公司有個Case, 客人响香港嘅時候境外申請Work Permit, 但係客人自己走去申請Study Permit, 可能佢覺得咁樣做係雙重保險, 跟住張Study Permit批咗先, 佢就拎住張 Study Permit 嘅 Approval Letter成功入境, 到咗之後先同我哋講佢拎咗Study Permit嘞, 到後來張Work Permit批咗出嚟, 佢就去邊境諗住Flagpole, 點知衰咗, 個關員reject佢嘅理由係因為佢已經有身份…就係張Study Permit, 結果我哋要幫個客用in-land嘅方式幫佢再申請多一次Work Permit, 咁又要等多幾個月…
雖然話關員操控住申請人嘅命脈, 其實只要申請人嘅文件、資料、學歷、工作經驗都符合當初提交申請嘅要求, 咁樣關員就搵唔到破綻去reject申請人啦。
