A PGWP application was refused because the applicant had one part-time semester during his studies.

At first glance, that may seem like a straightforward eligibility issue, but there was an important piece of context:
📌 The semester was completed entirely outside Canada during COVID-era distance learning.

🧠 Our approach?
We didn't simply reapply. We challenged the refusal through a carefully prepared reconsideration request, focusing on how the officer had interpreted the requirement for “full-time student status in Canada.”

We built the case around:

🎉 PGWP APPROVED EVEN WITH PART-TIME STUDIES OUTSIDE THE FINAL SEMESTER

❌ PART-TIME semester outside of the final academic term
⚠️ Major PGWP eligibility concern

✅ PGWP APPROVED

This was not a straightforward PGWP application.

The applicant completed a 4-year Bachelor of Business Administration at Memorial University of Newfoundland.

But there was one serious issue:

👉 During the FIRST semester of the program, the applicant became PART-TIME.

Normally, PGWP applicants are expected to maintain full-time student status throughout their program, except in limited circumstances such as the final academic term.

And this was NOT the final semester.

So why was the PGWP approved?

🛠 OUR APPROACH

We did not simply ignore the part-time semester or hope IRCC would overlook it.

We built a detailed legal and factual argument around exactly when, where, and why it happened.

✔️ Demonstrated that the applicant originally enrolled full-time with every intention of complying with the PGWP requirements

✔️ Explained that previously completed courses were unexpectedly accepted as transfer credits, reducing the number of courses required

✔️ Documented attempts to register in replacement courses, but available course capacity prevented the applicant from maintaining the original course load

✔️ Established that the entire semester occurred outside Canada while the applicant was studying remotely during the COVID-era facilitation period

✔️ Built a technical interpretation around the PGWP requirement to maintain “full-time student status in Canada” and how that wording applied to this unusual period of remote study

✔️ Demonstrated that this was an isolated semester, followed by years of continuous full-time studies

✅ FINAL RESULT

🎉 PGWP APPROVED

✔️ Part-time semester fully disclosed and addressed
✔️ Eligibility concerns explained through a detailed submission
✔️ 3-YEAR PGWP APPROVED

💡 THE IMPORTANT LESSON

A PART-TIME semester outside your final semester is a serious PGWP issue.

But it does not necessarily mean automatic refusal in every factual situation.

In this case, the circumstances were highly unusual because the semester occurred entirely outside Canada during the COVID remote-study period, and the reduced course load resulted from transfer credits and course availability.

👉 The outcome depended on understanding the policy, the timeline, and how the rules applied to these specific facts.

PGWP cases are not always as simple as “full-time = eligible” and “part-time = refused.”

Sometimes, the details make all the difference.

Although this client took her language test before submitting her application and passed all of the requirements, her PGWP was refused before she FORGET to upload her language test.

We quickly submitted a reconsideration and restoration application, and the reconsideration request came back approved within 2 weeks!

If you have:
1. taken a language test BEFORE submission,
2. got eligible CLB scores across reading, writing, listening, and speaking,
3. and the only mistake was forgetting to upload the test itself,

then you have a good chance of turning the refusal around by submitting a reconsideration request and restoration of status application just as did client did.

Note, the IRCC has now updated the document checklist to include a PROOF OF LANGUAGE PROFICIENCY field under the optional documents section, so those who apply from May 26th onwards may not get this same mistake reconsidered anymore.

Reconsideration is not a fall-back plan.
In most cases, reconsiderations are not successful unless the IRCC officer made a mistake in assessing your application.
Do not risk these mistakes by applying alone.

Many applicants assume that a straightforward PGWP application will be approved as long as they meet the requirements.

Unfortunately, even seemingly simple applications can be refused because of:
❌ Missing context
❌ Misunderstood evidence
❌ Confusing information
❌ Officer error

In this case, the officer concluded that our client had studied part-time during one academic semester and refused her PGWP application.

However, that assessment was incorrect.

🏫 We contacted the DLI to obtain the specific supporting letters, policies, and institutional records needed to clarify our client's enrollment history.

📄 We then prepared a new PGWP application with a detailed representative submission explaining:
✅ Why the previous assessment was incorrect
✅ How the DLI defined full-time studies
✅ Why our client had maintained full-time status
✅ Why she remained eligible for the PGWP

🎉 The new application was approved.

This case is an important reminder:
Immigration applications should not simply contain documents.

They should clearly explain any part of the application that could confuse the officer, appear inconsistent, or lead to the wrong conclusion.

PGWP refusal isn't always the end of the road.

This client's PGWP was refused due to a low language test score below the required threshold.

We had submitted a reconsideration request, but it was ultimately refused.

However, we also applied for a restoration of status and a study permit application at the same time, focusing on key factors immigration officers often assess and consider in these types of cases.

The restoration of status and the study permit were approved, which has now allowed the client to begin their Master's program in September.

Ultimately, with a Master's degree and the opportunity to apply for a 3-year PGWP after graduation, the client will be in a much stronger position to qualify for PR in the future, securing a clearer path to long-term stay in Canada.

Although a reconsideration request refusal is often very discouraging, there are still ways to explore other ways of extending your stay in Canada.
