Be Prepared! And know your limitations...
There is nothing worse than showing up to court on a file dealing with an area of law that you are clearly unfamiliar, and embarrassing yourself. When the judge hears your arguments and responds "you don't work in this area of law, do you?". That, is unacceptable. It's unfair to your client and as opposing counsel, you are left with no other choice but to advocate for your client, even while cringing in despair the entire time.

Okay, you had to apply to LTB to have your deadbeat tenant evicted. Success! Eviction order has been provided by the board. But how do you collect the money that you are still owed?

While it's always great to be willing to learn an expensive lesson about bad tenants, sometimes it doesn't hurt to seek advice on how you may be able to recover this money.

The cost of investigating whether or not your ex tenant has the resources to pay the money that they owe you would be nominal in comparison to the thousands of dollars you'd be walking away from.

Landlord Alert: Yes, getting your unit rented is paramount. But allowing someone to move in without provision of at least one months rent is ill-advised. If a perspective tenant cannot afford to provide at least one full months rent via certified cheque/money order/email transfer, etc. .. odds are they won't have the money to pay rent for the months to follow. Be selective, take time to investigate ahead of time and more importantly, ensure that you don't end up having to visit the LTB within 3 months because you took the first friendly face. This is your investment, don't let a new tenant use it like a charity.

Alert: having a roommate is a great way to save on the expenses associated with living in an expensive rental market. But please, don't let the allure of money blind you to the inherent risk. Do your due diligence and investigate your perspective roommate. An ounce of prevention goes a long way!

There is a rising trend of rogue tenants running amuck and taking unsuspecting landlords for a ride. The RTA is there to protect but sometimes, in the wrong hands, it ends up being a sword against unlucky landlords. While it may seem economical to proceed unrepresented in the face of rising arears, that decision can cost you everything. Never mistake the importance of legal representation and guidance. Even if you chose to proceed on your own, avail yourself to a free consultation... or two....it may prove invaluable!
