• Treat criminal release conditions, probation terms, and family-court arrangements as separate legal issues. A family agreement does not automatically change a criminal condition.
• Follow every written criminal condition exactly. Do not assume that a parenting schedule, text message, or informal permission overrides it.
• Do not use children, relatives, teachers, or friends to pass along messages if indirect contact may be restricted.
• Avoid unplanned contact during school pickups, exchanges, or visits. Ask counsel how those arrangements should be handled safely.
• Keep a written record of questions, proposed changes, and concerns for your lawyer. Do not request or agree to changes without legal advice.
• Shared property can create additional communication and access concerns. Obtain advice before attending a shared home or collecting belongings.

More than 500 days without seeing a child is an unimaginable experience for any parent.

A recent CP24 report describes a Brampton father’s efforts to locate his young son after the father said the child was retained in Poland. The report states that a Polish court ordered the child’s return to Canada, but the scheduled return did not occur. Peel Regional Police issued a Canada-wide warrant for abduction of a person under 14.

Cases like this show why international family-law matters can be so complex. A Hague Convention return proceeding is generally about returning a child to the appropriate jurisdiction; it is not the same as a final decision about parenting. Criminal processes and consular assistance are separate parts of the response.

If a child is taken or retained outside Canada, parents should act promptly, preserve travel and court documents, keep records of consent and communications, contact the relevant Hague Central Authority, and obtain advice about coordinated steps in Canada and abroad.
