Land Owner Transparency Act – Important Deadline Approaching: November 30, 2022

Does your company own property? Do you or your company hold property in trust for a third party? If so, you may be required to file a LOTR Report. The Land Owner Transparency Act requires all “reporting bodies” who held an interest in land before November 30, 2020 to file a transparency declaration and report by November 30, 2022. Failure to file by this deadline may lead to substantial fines and penalties. Give our team a call if you have any questions. We’re here to help!

If your company owns property in its name, or if you personally own property in trust for someone else or your company, a LOTR (Land Owner Transparency Registry) Report must be filed by November 30, 2021.

If you’ve recently completed a purchase (after November 30, 2020) this report would have been filed at the time of the purchase. If you purchased prior to November 30, 2020, and you qualify as a “reporting body”, the November 30, 2021 deadline applies to you.

Property Tax Notices have been sent out, so keep your eyes open for yours. Just a reminder that the deadline is July 2, and the Home Owner Grant (HOG) should be claimed as soon as possible (for those eligible to apply).

You can now apply directly through the Province of BC using the link below. Cities are no longer accepting HOG applications.

The home owner grant can reduce the amount of property taxes you pay to a municipality or the province for your principal residence.

The new Land Owner Transparency Registry (LOTR) is now open to the public. The registry contains information about anyone who may have an indirect ownership in land (ie. the land is held in trust for them, or held by a company in which they are an interest holder).

We’ve been filing LOTR declarations and/or reports for all new transfers/purchases since November 30, but there are more deadlines coming up later this year for existing owners to disclose any indirect ownership.

Rest assured, we will keep our clients and referral sources informed and we’ll post more information soon.

Transparency information on interest holders of B.C. real estate is available for public search in the Land Owner Transparency Registry, giving law enforcement and tax authorities a significant tool to combat money laundering in the real estate market.
