Did you know: You have one year to Commence a Lien Action (i.e. legal proceedings) from the day you register your builders lien.
Section 33(1) of the Builders Lien Act provides a one-year time limit from the date the lien claim was filed for commencing the action to enforce the claim of lien.

At the time the claim of lien is filed, it is prudent to contact a lawyer to ensure your lien is enforceable. It is always important to contact a lawyer well before the one-year limitation period and to instruct the lawyer in sufficient time in regards to the commencement of the action. The Builders Lien Act requires all the parties in the payment chain – owners, contractors, sub-contractors etc. – must maintain a 10% holdback from the parties below them in the chain including contractors, sub-contractors, and sub-sub-contractors. This 10% holdback is not related to the possibility of deficiency claims, delay claims, or other potential liabilities that a contracts workers or a subcontractor may endure. Indeed, numerous construction contracts will incorporate further holdback sums for things like possible deficiencies. The 10% builders lien holdback isn't identified with your agreement and you can't contract out of this requirement.

Any contractor or subcontractor must holdback 10% of the agreement cost until the finish of the holdback period. Note that you don't holdback back funds from laborers, material providers, architects or engineers.

The holdback period expires after 55 days following the date the certificate of completion is issued. Payment of the holdback can be made on the 56th day, assuming no valid lien is filed on title and no lawsuit is commenced to enforce a lien.
