In or out of community of property?

You have a right, as a couple threatening to tie the knot, to pause while sending out those fancy wedding invitation cards to friends and relatives, to discuss, Call and Consult your Lawyer, about which proprietary marital regime (in or out) will work for you.

What works for your mentor, or next door neighbour, or your best friend may not necessarily suit you and your partner. You need to understand that marriage is a life long legal contract during which, you and your partner will have fun, bear children if you like, acquire property, amass wealth, and or incur lots of debts and get each other into all sorts of financial woes and trouble, if you both are not too smart with finances.

For this reason, you cannot get into holy matrimony the same way you stroll into a small village bar, whence you can simply walk out if you don't like the smell of the brothers standing by the counter. You get in, you get out when God calls you; that is, if you meant everything you repeated after your Pastor.

You need to sit down with a Lawyer and receive counsel on what will work for your current lifestyle and your future aspirations as a couple.

If you are already knee deep into it, don't panic. You can make a u-turn provided that you and your spouse reach a consensus. Your Lawyer should sort you out, if you pay your fees on time.

Don't get into any Contract without sound legal advice.

Do you have a Will or a Way?

Quite too often, we work so hard for a decent lifestyle and fine things in life that we forget to even live. We work long hours for money and profits to take care of our loved ones who we hardly ever see let alone spend quality time with. Quality time with family is replaced with gifts and gadgets.

While we kill ourselves to earn more money, we forget the real finer things in life - small things like planning your estate.

Disremebering such a small thing like making provision for your loved ones after you go to heaven, may have a tremendously disastrous impact on the life that your loved ones lived when you were alive. Your dear uncle back in the village with whom you last spoke when you were learning how to talk immediately walks into your house soon after you are certified dead and takes over the management of your household and assets.

Of course, he doesn't know what WiFi is and why your children play with expensive smart gadgets. For him, a good school is the most nearest to his/your house to save your little spoilt brats, as he sees them, a long walk to school. He doesn't care about the school drop off and pick up rush hour because he doesn't have to deal with it - your kids will to walk for free public education.

Is this the way you want to leave those that you so dearly worked hard for? Contact and or consult an estate planning lawyer to avoid this sad new life for your loved ones. You can have a Will wether you are stinking rich or you earn your salary in a brown envelope. You can decide now, when you are still alive, what schools your children go to, who keeps your rabbit and parrot, who controls and manages your money and assets for the benefit of your family, and who lives in your house and drives your Mercedes etc post your residence on earth.

There is a demand letter which our firm wrote on behalf of our client Hon MP Guma Moyo. We gave client a copy to deliver to the addressee and another for his records. The letter is now apparently on Facebook. We'd like to make it clear that we have no control over what client does or did with his copy, who he shares or shared it with, and also indicate that we did not partake in the posting of the said letter on Facebook and would never do that. Thank You.
