Do you want to adopt a child?

Adoption Of Children's Act (Cap 28:01) is the legal instrument that outlines the requirements, processes and procedures governing adoption of children.
Adoption of Children is done through an application to the Magistrates Court. This means that you must have a supporting affidavit (sworn statement) outlining the basis of your application.

Who qualifies to adopt?

# Husband and Wife jointly.
# Widower/ Widow or Divorced or Unmarried person.
# If you are married but separated by a court order/decree you also qualify to adopt.
# A married person whose spouse at the time of adoption has been suffering from mental illness for a continuous period of atleast 7 years can also adopt a child.

Age difference between the Adopter and Adoptee.

The Act requires that a prospective parent must atleast be 25 years older than the child (there is an exception that allows for such if both Adopter and Adoptee are of the same s*x).

In the next Post we shall consider exception to the above requirements before outlining the process.

Dear Valued Clients,

Pursuant to the lockdown declared by His Excellency The President last night, from the 30 August 2020 until 13 August 2020 for the greater Gaborone region the Chief Justice has issued Practice Directive No.7 of 2020 with respect to court operations.

For the period of the lockdown courts shall remain closed save only for hearing of urgent applications. Matters scheduled for hearing within this period will be deferred to dates to be announced after the State of Emergency is lifted.

Existing time bound orders/directions of court arising from and/or in terms of the Rules of various Courts will remain suspended for the duration of the lockdown.

SEBEGO ATTORNEYS remains dedicated to client’s work and as such please note that members of the team will be reachable over cellphone and email throughout the lockdown period.

We urge clients and the general public to observe the safety guidelines imposed by the State throughout this challenging period.
