Ativismo judicial e Judicialização da Política

A começar de seu conceito, é bastante discutível a questão que envolve o ativismo judicial e a judicialização da política.
Embora não haja um consenso sobre o conceito de ativismo judicial, basicamente significa a postura proativa do Poder Judiciário que interfere de maneira direta nas questões políticas dos poderes.
Ou seja, pode significar uma escolha proativa do Poder Judiciário de interpretar a Constituição, expandindo o seu sentido e alcance, criando uma regra específica que não estava prevista.
Nem sempre a pratica do ativismo judicial é um exercício democrático e por esta razão, controverso, uma vez que juízes não eleitos pelo povo podem, através de suas decisões, derrubarem a vontade do povo.
Pelo lado positivo, o ativismo judicial é o papel criativo dos tribunais ao trazerem uma contribuição nova para o direito e relações, formando o precedente jurisprudencial, antecipando-se à formulação da própria lei.
O ativismo judicial é, portanto, dentro dos limites em que não fira a constituição ou decisões do legislativo, desejável e eficaz.
O sistema legislativo brasileiro é lento e burocrático. E sem nenhuma crítica ou juízo de valores a respeito do sistema, é possível dizer que o ativismo judicial é até desejável em algumas circunstâncias como, por exemplo, nas brechas ou normas obsoletas que não condizem com a realidade e necessidade social.
No entanto, há que se cuidar para que o ativismo judicial não extrapole as leis existentes ou que resulte na desestabilização da democracia e desrespeito à separação dos poderes.
A Judicialização da política ocorre quando há a transferência de decisão dos poderes Legislativos e Executivos para o poder Judiciário, o qual passa a estabelecer normas e condutas a serem seguidas pelos demais poderes.
Em ambos os fenômenos as conseqüências são semelhantes, ou seja, as questões ou decisões políticas de competência do Executivo e Legislativo acabam por serem decididas pelo Poder Judiciário.
Ocorre que o excesso do ativismo judicial pode resultar em autoritarismo e enfraquecimento da democracia.
