📃Law 14.382/22 modernized public registries in Brazil, creating the Electronic System of Public Registries (SERP). Its aim is to make registry services easier and less bureaucratic, ensuring greater efficiency and accessibility.😊
❗Interconnected system:
SERP is an interconnected electronic system that connects all registry offices and allows unified access to information, such as consulting and registering documents remotely, without the need to travel to the office.
❗Mandatory electronic registration:
In addition, all civil, real estate and securities registry offices must offer online services. This means that registration acts that were previously done in person must now be accessible digitally, ensuring greater convenience and agility.
❗Remote services available:
1️⃣Consultation and request of documents;
2️⃣Electronic protocol for requests for annotations, registrations, etc.;
3️⃣Digital notarial acts.
❗Transformations in the Real Estate Registry:
↪️This new regulation introduces rules that speed up real estate transactions, as well as ensuring greater security.
↪️Reduction of the deadline for real estate registrations to 5 working days (except in more complex cases);
↪️Possibility of electronic signature on public deeds by means of advanced or qualified electronic signature;
↪️100% digital Purchase and Sale of Real Estate, without the need for physical presence at the registry office.
❗Easier name and surname modification:
Persons at legal age and civil capacity are now able to change their first name, just once, directly at the registry office, without having to provide a justification. Surnames might also be changed more flexibly, such as adding family members' surnames at any time.
❗Registration of docs at the RGI:
Previously, only docs expressly provided for in legislation could be registered with the Real Estate Registry.
Now, subrogations and other occurrences that in any way alter the registration or have repercussions on the rights relating to the property will be recorded in the registration.
