Gabriel Cruz was featured in an article on the Portas website about the effects of construction stoppages on real estate buyers and the situations in which they may be entitled to terminate the contract and receive a full refund of the amounts paid.
According to Gabriel Cruz, when a construction freeze results from procedural failures by the developer, such as the absence of a building permit or environmental license, this may constitute a breach of contract. The attorney also distinguishes between internal and external force majeure: while the former involves risks related to the developer’s own business activities, the latter corresponds to an event that is external to the business and unforeseeable. In this regard, a construction freeze caused exclusively by a third party, unrelated to the developer’s conduct and entirely unforeseeable, may, depending on the circumstances, constitute a fortuitous event or force majeure capable of excusing the developer’s default.
