Правото (законът) трябва да е разбираемо и ясно за всеки член на обществото. В противен случай, няма как ефективно да изпълнява основната си роля: да осигурява личния и общия мир, ред, сигурност и благосъстояние. Всеки законодател е задължен изначално и ще носи отговорност, ако се провали в това отношение. Всяко силно (демократично) общество трябва незабавно да налага тази отговорност, в случай на провал на законотвореца. (Една закъсняла мисъл след Деня на Конституцията, 16 април.)

Могат ли да бъдат вредни за българската икономика и правова държава регулатори като Комисията за защита на конкуренцията?

Накратко, ако един регулаторен държавен орган не изпълнява ефективно и в пълен обем възложените му по закон правомощия този орган не функционира в полза на обществото и икономическото развитие. И там, където регулираният от закона пазар не е в достатъчна степен конкурентен и либерализиран и пазарната сила е концентрирана в един или малко на брой пазарни участници, бездействието на регулатора нанася преди всичко непреки вреди (напр. разпределяне на пазари, налагане и поддържане на високи непазарни цени, ограничаване на предлагането и инвестициите в нови продукти и услуги, създаване на бариери за навлизане на пазара).

Само икономически анализ на преките и непреките икономически ефекти в отделни сектори и икономиката като цяло може да даде отговор и оценка на вредите, които да послужат за целите на дискусията и препоръки. В очакване на такъв анализ, има количествени и качествени критерии за оценка на ползите и вредите от дейността или съответно бездействието на един регулаторен орган като КЗК.

Накратко, ако един регулаторен държавен орган не изпълнява ефективно и в пълен обем възложените му по закон правомощия този орган не функционира в полза на обществ...
