Bulgarian Legislative Framework Updated to Implement the EU Digital Services Act

On 21 November 2025, amendments to the Bulgarian Electronic Communications Act (ECA) implementing the EU Digital Services Act (DSA) were promulgated in the State Gazette.
∙ The Communications Regulation Commission (CRC) is designated as the national Digital Services Coordinator, responsible for monitoring compliance with the DSA by all providers of intermediary services
∙ The Council for Electronic Media is the supervisory authority for video-sharing platforms
∙ The Commission for Personal Data Protection is responsible for monitoring advertising based on profiling and protecting minors from targeted advertising

The amendments to the ECA empower the CRC to certify out-of-court dispute resolution bodies, award the status of trusted flaggers and vetted researchers, and collect information from a broader range of actors in the digital ecosystem (DNS providers, hosting companies, cloud services, online platforms etc.) in Bulgaria.
A new procedural regime will apply to inspections, the collection of evidence, and the application of urgent interim measures to prevent serious harm, including temporary restrictions of access to digital services.
Together, these amendments complete the national framework for the implementation of the DSA in Bulgaria.

DGKV marked its 30th anniversary on 16 September 2025 with a celebration which brought together clients, partners, colleagues and artists, at Sofia Tech Park’s John Atanasoff Hall.

Art and Innovation at the Heart of the Celebration

The highlight of the evening was DGKV’s collection of contemporary Bulgarian art presented in an immersive 3D mapping.

The collection includes works by iconic Bulgarian artists, such as Bozhidar Boyadjiev, Deyan Petrov, Genadi Gatev, Georgi Ruzhev, Georgi Tushev, Gredi Assa, Houben Tcherkelov, Ivan Kiuranov, Ivan Kostolov, Kokimoto, RASSIM, Ventsislav Zankov, Vihroni Popnedelev, among others and reflects DGKV’s long-standing commitment to culture and art.

Curator Margarita Dorovska, the art director of the presentation, emphasized the significance of the collection:

“DGKV’s collection features works by artists who have become close friends over time, with careers followed and supported through decades. The collection embodies personal narrative, exploration, and bold creativity—mirroring DGKV’s corporate spirit and vision. Through this 3D projection, the artworks were brought to life in an innovative way, creating a unique experience for our guests.”

With the Euro Act ⚖️ and its recent amendments now in effect, businesses face key compliance milestones: obligations for 💱dual price display and ❌ a ban on unjustified price increase during the Period (8 August 2025 – 8 August 2026), 💳 payment processing rules during the Period (1 January 2026 - 1 February 2026), and new duties to provide information to 🏛️. Automatic conversion of bank accounts, securities, and payrolls will ensure a smooth transition, but companies must adjust their 📊 accounting practices after 1 January 2026. Moreover, they must update their 🗂️ corporate documents and internal policies before the end of 2026.

Several significant amendments to the Administrative Procedure Code (“APC”) were promulgated in the State Gazette on 1 August 2025. The changes will take effect gradually – some provisions are effective immediately upon promulgation, others three days later, some one month after promulgation, and certain key provisions on 1 January 2026 and 1 July 2026, respectively. This phased entry into force is designed to allow administrative bodies and administrative courts, as well as citizens and businesses, sufficient time to adapt to the new legal framework.

These legislative changes are primarily focused on the digitalization of administrative proceedings, both before administrative authorities and in administrative court litigation. The goal is to streamline procedures, reduce delays and ensure full digital traceability.

Bulgarian Parliament Enacts Important New Law Allowing Individuals to Clear Personal Debt

Bulgaria has taken a major step toward modernizing its insolvency framework with the adoption of the first-ever Law on the Insolvency of Natural Persons (LINP). Passed by the Parliament on June 19 and set to come into force in July 2025, the law offers a formal mechanism for non-entrepreneurial individuals struggling with debt to seek relief through the courts.
Under the new law, individuals who have been unable to meet their financial obligations for more than 12 months and owe at least BGN 10,770 will be eligible to file for insolvency. The process is voluntary and can only be initiated by the debtor, with creditors having limited authority to intervene.
To qualify, debtors must act in good faith and cooperate fully with the court, which oversees the insolvency proceedings. The law outlines a two-phase process: an initial assessment, followed by either approval of a repayment plan or, failing that, liquidation of the debtor’s assets. Certain categories of debt—such as child support and court-imposed fines—remain exempt from discharge.
Lawmakers say the legislation aims to balance the interests of debtors and creditors while offering overburdened individuals a second chance at financial stability.

Key Provisions of the EU AI Act shall become applicable from 2 August 2025
Starting 2 August 2025, Regulation (EU) 2024/1689 (AI Act) will mandate that providers of general-purpose AI (GPAI) models — those AI models that display significant generality and are capable of competently performing a wide range of distinct tasks — on the EU market comply with specific obligations.
All GPAI model providers must prepare technical documentation, a copyright policy, and a detailed summary of the training content. Non-EU providers must designate an EU representative. Providers of GPAI models that pose systemic risks must conduct risk assessments, implement risk-mitigation measures, report serious incidents, and ensure cybersecurity.
To demonstrate compliance, providers may rely on codes of practice. The European Commission received the final version of the GPAI Code of Practice on 10 July 2025. It is expected that the Member States and the European Commission shall endorse the Code in August 2025.
Transitional Period: GPAI models that have been placed on the market before 2 August 2025 must comply with the AI Act by 2 August 2027. As regards new models, the applicable rules shall become enforceable by the European Commission as of 2 August 2026.
In addition, by 2 August 2025, Member States should designate national competent authorities and establish rules for penalties. Bulgaria has yet to designate its authorities and adopt national implementing legislation. At this point, only the authorities protecting fundamental rights have been identified.

От 2 август 2025 г. Регламент (ЕС) 2024/1689 (Акт за ИИ) ще изисква от доставчиците на модели на изкуствен интелект с общо предназначение (ИИОП) — модели, които имат до голяма степен общ характер и са в състояние да изпълняват широк набор от отделни задачи — да спазват определени задължения при предлагането им на пазара на ЕС.
Всички доставчици на ИИОП модели трябва да изготвят техническа документация, политика за авторски права и подробно резюме на използваното обучително съдържание. Доставчиците извън ЕС трябва да определят представител, установен в Съюза. Доставчиците на ИИОП модели, пораждащи системен риск, ще трябва да извършват оценки на риска, да прилагат мерки за неговото ограничаване, да докладват за сериозни инциденти и да осигуряват киберсигурност.
С цел доказване на съответствие, доставчиците могат да се позовават на кодекси за поведение. Европейската комисия получи окончателната версия на Кодекса за поведение в областта на ИИОП на 10 юли 2025 г. Очаква се държавите членки и Европейската kомисия да го одобрят през август 2025 г.
Преходен период: ИИОП модели, пуснати на пазара преди 2 август 2025 г., трябва да отговорят на изискванията на Акта за ИИ до 2 август 2027 г. За новите модели, правилата ще започнат да се контролират от Европейската комисия, считано от 2 август 2026 г.
До 2 август 2025 г. държавите членки следва да определят национални компетентни органи и да приемат правила относно санкциите. България все още не е определила своите органи, нито е приела национално законодателство за прилагане на регламента. Към настоящия момент са идентифицирани единствено органите за защитата на основните права.
