Belgium’s Court of Cassation confirms that CBAs, even when extended by Royal Decree, can be struck down if they conflict with the constitutional principle of equality and non-discrimination.

The case concerns trade union elections where a sector CBA excluded a category of employees.

Two years of Whistleblower legislation in Belgium: how are companies handling it in practice?

In January 2026, Gautier Busschaert and Lara Coël of Van Olmen & Wynant's Employment team published an article in the legal journals Orientations and Oriëntatie. Triggered by the legislation's “two-year” mark, the article is the result of a survey amongst companies, organisations and institutions to see how they implemented the Whistleblower legislation in practice.

On 23 February, the government introduced a legislative proposal amending the statutory notice periods.

The proposal would standardise the notice period at one week during the first six months of employment, effectively reintroducing a form of probationary period.

A legislative proposal of 23 February 2026 introduces the so-called wage indexation cap (“centenindex”), an important change to the existing indexation system.

The measure will apply to both the private and public sectors and introduces an adjusted wage indexation mechanism in two phases, with a first intervention as from June 2026 and a second as from January 2028.
