We bid a fond farewell to Mr. Md. Moazzem Hossain, a highly respected Senior Associate who is retiring after an illustrious legal career that began in 1984. Since joining Rahman's Chambers in 2016, he has been a pillar of our Dispute Resolution and Commercial Departments, playing a major role in the swift disposal of complex cases in the Dhaka District and Magistrate courts. Known for his relentless effort and tactical brilliance as a trial lawyer, he successfully secured numerous firsthand judgments in critical land, banking, and commercial litigations. His dedication not only earned him the deepest respect of his colleagues and clients but also contributed significantly to the firm's prestigious rankings by Chambers and Partners. We sincerely thank Mr. Hossain for his outstanding service to the firm and wish him a peaceful, healthy, and well-deserved retirement.

Rahman’s Chambers is proud to share the active participation of our Head of Chambers, Barrister Mohammed Forrukh Rahman, at the landmark seminar titled “Strengthening Bangladesh’s Commercial Justice System: Commercial Courts Act 2026 and Reform of the Arbitration Act 2001”. Organized by the Bangladesh International Arbitration Centre (BIAC) in support of the United Nations Development Programme (UNDP), the event was held at Hotel InterContinental Dhaka on 21 May 2026.

Mr. Mahbubur Rahman, Chairman of BIAC, delivered the welcome address highlighting the need for a modern commercial justice system. Introductory and special remarks were delivered by Mr. Stefan Liller, Resident Representative of UNDP Bangladesh, and H.E. Michael Miller, EU Ambassador to Bangladesh.

Chief Guest, Mr. Md. Asaduzzaman, MP, Honorable Minister of Law, Justice and Parliamentary Affairs, emphasized the necessity of re-examining the newly passed Commercial Courts Act and reforming the Arbitration Act 2001. Madam Justice Fatema Anwar delivered the keynote address on commercial litigation and arbitration.

Barrister Sameer Sattar provided expert observations on the need for commercial courts to strengthen the business environment. He also moderated the first panel, “The Implementation and Practical Challenges of the Commercial Courts Act 2026,” featuring Mr. S. M. Arshadul Alam, Additional Secretary; Mr. Marcus Davies, Political Counsellor (Canada); and Dr. Sharif Bhuiyan, Senior Advocate.

Reflecting our firm's core focus on alternative dispute resolution, the second panel addressed “Reforming the Arbitration Act 2001: The Enforcement.” Our Head of Chambers, Barrister Mohammed Forrukh Rahman, featured as a distinguished panelist in this vital session alongside Barrister Saqeb Mahbub and Barrister Margub Kabir. The discussion was expertly moderated by Barrister Syed Afzal Hasan Uddin.

Following the panels, Mr. Gazi AKM Fazlul Haque, Director General of BIDA, shared remarks from an investor’s perspective. At the closing session, Ms. Romana Schweiger, Senior Advisor at UNDP Bangladesh, provided closing remarks.

The article, "Investment Arbitration of Bangladesh", highlights how the traditional doctrine of absolute state immunity against foreign jurisdictions and ex*****ons is evolving. To foster a favorable investment climate and protect citizens, many nations, including Bangladesh, have ratified the Washington Convention (ICSID Convention).
Currently, Bangladesh protects foreign investors through the Foreign Private Investment Act, 1980, and ICSID clauses across several of its 30 bilateral treaties. However, executing foreign arbitral awards remains complex due to lingering sovereign immunity challenges. To secure mutual interests, thorough due diligence before signing investment agreements is crucial. Explicitly incorporating arbitration clauses with express ex*****on immunity waivers ensures robust protection and safely unlocks available corporate opportunities.

The article, "LAWS & REGULATIONS APPLICABLE FOR SPONSOR/DIRECTOR/PROMOTER OF LISTED COMPANIES OF BANGLADESH", highlights that protecting public investors from market manipulation requires stringent regulatory oversight. Currently, sponsors, directors, and promoters must adhere to a strict compliance framework, including maintaining a joint minimum 30% shareholding and navigating strict lock-in periods.
