The Constitution of Bangladesh, through Articles 37 and 38, guarantees every citizen the right to peaceful assembly and to form associations, subject only to reasonable restrictions in the interest of public order, morality, and health. What it forbids are associations that incite hatred, destroy communal harmony, create discrimination, or promote terrorism.
This is not unique to Bangladesh. Article 19 of the Universal Declaration of Human Rights, Article 21 of the ICCPR, the U.S. First Amendment, and Article 11 of the European Convention on Human Rights all affirm the same principle, the right to peaceful assembly and association as a cornerstone of democracy.
Therefore, unless the Government officially declares groups like ‘Freedom Fighters’ platforms, Muktijuddho Mancha, or Munch-71 as terrorist outfits, there is neither a constitutional nor a moral ground to arrest or harass citizens for exercising their peaceful and democratic rights.
