The Department of Home Affairs has announced that starting July 1, holders of tourist visas or 485 work visas within Australia will be prohibited from applying for student visas.

In the 2022-23 fiscal year, the number of international students in Australia increased by over 30%, reaching 150,000. In the immigration reform report released last year, the Australian government revealed plans to close the visa loophole that allows temporary visa holders to indefinitely extend their stay in Australia through student visas. In addition to the Genuine Temporary Entrant (GTE) form implemented in March for study applications, this new restriction on visa holders switching to student visas is another measure aimed at reducing the net overseas migration numbers. The goal is to halve the net overseas migration in the next fiscal year.

19/03/2024

The immigration authority has formally legislated to remove the requirement for "genuine study" in student visa applications, allowing applicants to openly express their intention to study with the prospect of immigrating to Australia.

The current Australian government recognises that, despite the previous requirements, many international students have obtained permanent residency over the years through studying first and then immigrating. Many of these students have also contributed to addressing skill shortages within Australia.

To prevent this requirement from hindering or causing confusion for applicants, it has been decided to eliminate the need for the study to be "purely academic" in student visa applications. Instead, a new Genuine Student Requirement will be used to assess student visa applications.

Under the new reforms to student visas, the immigration authority will still consider factors such as immigration history, compliance with visa conditions, and any other relevant matters.

While the immigration authority is relaxing the requirement regarding the intention to immigrate through studying, the purpose of the reform is to ensure that relevant visa categories are used appropriately. Therefore, there will still be strict measures against applicants intending to work in Australia through student visas. Additionally, visa applications are always individually assessed, granting visa officers greater discretion in deciding whether to approve visas.

End of the two-year extension of post-study work rights
The extended post-study work rights for international graduates commenced 1 July 2023, providing graduates with degrees in select areas of verified skill shortage an additional two years on their Temporary Graduate visa (subclass 485).

The extension has been reconsidered given Australia’s changed economic environment and additional considerations as identified in the Migration Strategy. As such, international higher education graduates will no longer be able to apply for the extension from mid-2024.

International graduates with an Australian qualification, that meet the Australian study requirement, remain eligible for the existing Temporary Graduate (Post-Study Work stream) visa.

Should you have any further questions related to this change, please refer to the Department of Home Affairs.
